Consumer Protection - Service - covered under the Act - Services rendered by educational institutions--Dental College which neither affiliated with a university nor recognized by Dental Council of India, admitting respondent students to BDS course for consideration - If amount to deficiency in service - Relief that may be granted Held, said act of the college fell within purview of "deficiency" as defined in the 1986 Act - Hence, National Commission rightly held that there was deficiency in service on part of the college -Thus, order of Commission directing refund of admission expenses to students with interest @ 12 % p.a., affirmed.
Considering that the College played with career of students and virtually ruined their career and that students had lost two valuable academic years, amount of compensation of Rs 20,000 granted to each claimant by National Commission, on the cross-objections of the students enhanced to Rs 1,20,000 4
-- College also directed to pay Rs 1 Lakh as costs of litigation to each of the claimants B. Consumer Protection -Cause of action - Unfair trade Practice--Meaning and scope of - Misrepresentation by College about its affiliation with a university and grant of recognition to it - Dental College neither affiliated with university concerned nor recognized by Dental Council of India (DCI), stating in its advertisement for admission to BDS course that it was under the above university and DCI - Held, this was a case of total misrepresentation on behalf of the College concerned - It tan amounted to an unfair trade practice.
