Section 109 in Madras Estates Land Act, 1908

109. Conflict between distress by landholder and attachment by Court.

- When any conflict arises between the right of a landholder distressing produce over which he has a first charge under sub-section (1) of section 5 and the right of a person claiming under an attachment by a Civil Court, the right of the landholder shall prevail; but if the property is sold by a Collector in consequence of such landholder's distress, the surplus proceeds of the sale shall not be paid under section 106 to the person whose property has been sold, but shall be deposited in the Court from which the order of attachment issued.
