1. This Original Application is filed by the applicants under Section 19 of the Administrative Tribunals Act, 1985 seeking the following relief: -

(i) That the record of the case be called for.
(ii) That directions be issued to the Respondents to consider the genuine plight of the Applicant and release arrears pending towards the applicant along with applicable interest and costs towards mental agony and litigation charges.

2. The case of the applicant is that the applicant joined service on regular basis, as Primary Teacher in the Kendriya Vidyalaya, Baramulla on 10.10.2017 and has rendered 8 years of service. Currently, the applicant is working as Primary Teacher in Kendriya Vidyalaya No. 3 Air Force Station, Bhisiana, Bathinda, Punjab. He completed his service at Kendriya Vidyalaya while he was posted at Baramulla, Jammu and Kashmir from 17.10.2017 to 21.10.2021 for span of 4 years and 4 days therefore he submitted that he was entitled to get special daily cash assistance and food allowance from K.V. Baramulla for the time he was posted there as primary teacher.

3. The applicant further submits that he got his special daily cash assistance and food allowance from K.V. Baramulla only for the year of 2017. The applicant did not get any special daily cash assistance and food allowance paid in his favour for the year of 2018 and part payments for the years of 2019, 2020 and 2021. It is agreed upon by the KV Baramulla that the allowance is pending in favor of the applicant for the years of 2018, 2019, 2020 and 2021.

4. The applicant sent a letter dated 10/02/2023 to Principal, K.V. Baramulla containing details of his total arrears i.e. Rs.86,148/- (Annexure P-2). Thereafter he sent reminders also.

The request of the applicant was moved by the Deputy Commissioner, Kendriya Vidyalaya Sangathan, Chandigarh Region vide letter dated 22.02.2024 (Annexure P-6) to Deputy Commissioner, Kendriya Vidyalaya Sangathan, Jammu Region stating the difficulties faced by the applicant in getting due arrears cleared, but no response ever from K.V.S. Deputy 3 Commissioner, Jammu Region. The respondent No.2 replied vide letter dated 20.11.2024 (Annexure P-8) wherein it was submited that the arrear request has already been forwarded to the KVS for processing and the due amount will be transferred directly to his bank account.

At this stage, learned counsel for the applicant submitted that the applicant will be satisfied if respondents are directed to take a time bound decision on his representation and expedite the process. To which, learned counsel for the respondents, on advance notice, submit that the respondents have no objection in taking a decision expeditiously.

7. In view of above, the O.A is disposed of at the admission stage itself. The competent authority amongst the respondents No.2-5 is directed to consider the contention of the applicant as per Rules and decide the same within a period of two months. No costs.

8. Needles to say that I have not touched upon the merits of the case.
