% 21.03.2018 Vide the present petition, the petitioner impugns the orders dated 31st January, 2018 and 28th February, 2018, issued by respondent nos.1 & 2 respectively. Learned counsel for the petitioner submits that even though despite the petitioner having informed the respondents that all the deficiencies found at the time of inspection of the Institute, were duly removed, the respondent no.2 has declined to re-inspect the petitioner/Institute on the ground that the information regarding removal of deficiency was received at a belated stage i.e. on 22nd January, 2018 and, therefore, there was not enough time for the respondent no.2 to inspect the same.

She points out that even though the respondents have rejected the petitioner's request for re-inspection by relying on the time schedule prescribed in the decision of the Supreme Court in the case of Ashish Ranjan & Ors. V. UOI & Ors., the respondents themselves failed to abide by the time schedule, as the first letter requiring the petitioner to remove the deficiencies was issued by the respondents only on 16th November, 2017, whereas according to the time schedule prescribed in the aforesaid decision, the deficiencies were required to be removed by 15th November, 2017.

Issue notice. Mr.Sanjeev Sabharwal, Advocate accepts notice on behalf of respondent no.1 and Mr.T. Singhdev, Advocate accepts notice on behalf of respondent no.2. Counter affidavit be filed by the respondents within two weeks. Rejoinder thereto, if any, be filed within two weeks thereafter.
