Section 25 in The Assam Highway Act, 1989

25. Highway authority require proprietor of village road dan to repari the road property where he is under obligation to do so.

(1)Where there is any obligations by law or by custom or otherwise on any land-lord or proprietary body to maintain a village road or track on which the public have or have acquired a permanent right of way and such road or track is not, in the opinion of any highway authority properly maintained that authority may issue a notice to the landlord or the proprietor to repair the road or track within such a reasonable time and in such manner as may be specified in the notice.
(2)If at the end of the specified period the repairs have not been carried out in the manner specified, and the landlord or the proprietor has not furnished any satisfactory explanation for non-compliance, the highway authority may move the State Government to transfer control of the road or track to it or to any other highway authority under sub-section (1) of Section 24.
(3)The State Government while directing the transfer of control of such village road or tack to any highway authority, may determine whether any, and if so what portion of the cost of repair which the highway authority may incur shall be recovered from the landlord or the proprietor in discharge of his obligation to maintain the road or track.
