1. This petition has been filed seeking bail in FIR No.237/2023 under Sections 419/420/467/468/471/120B/201/34 IPC and 66C/66D of IT Act PS Special Cell. The petitioner has been in custody since 23 rd November, 2023. Investigation is complete and charge-sheet has been filed.
2. As per the status report, the FIR was registered on the complaint of Mr. Devender Singh alleging that he has been induced by some unscrupulous individuals to deposit money on pretext of allotment of IOCL petrol pump. At the behest of the accused, he filled his registration details on a fake website [email protected].
3. As per the complaint, one Ajit Singh impersonating himself as an officer for IOCL approached him on his mobile and asked for relevant KYC documents. Someone else also impersonated himself as senior officer of Ajit Singh.
4. Both Ajit Singh and his 'senior' called the complainant number of times and asked for deposit of money. Initially, he was informed that he was eligible for allotment of IOCL petrol pump and deposited a sum of This is a digitally signed order.

Later, the complainant was told that he had been selected for allotment of IOCL petrol pump and, therefore, for that purpose, deposited Rs.52 Lacs.
5. Investigation ensued and four mobile phones recovered from the petitioner and only one mobile phone was belonging to the petitioner.
6. It is also stated by the APP for the State that as per the CCTV of the ATM when the withdrawals were made, the accused was not identified.
7. However, now considering investigation is complete and charge-sheet has been filed, there would be no purpose continuing the custody of the petitioner.
8. Considering the above, and that the trial in the matter is likely to take some time, and it would not be prudent to keep the petitioner behind bars for an indefinite period, this Court finds it to be a fit case for grant of bail to the petitioner.
9. Consequently, the petitioner is directed to be released (if not in custody in any other matter) on bail on furnishing a personal bond in the sum of Rs. 25,000/- with one surety of the like amount subject to the satisfaction of the Trial Court, further subject to the following conditions:
i. Petitioner will not leave the country without prior permission of the Court.
ii. Petitioner shall provide permanent address to the Trial Court.
The petitioner shall intimate the Court by way of an affidavit and to the IO regarding any change in residential address. iii. Petitioner shall appear before the Court as and when the matter is taken up for hearing.

v. Petitioner shall provide all mobile numbers to the IO concerned which shall be kept in working condition at all times and shall not switch off or change the mobile number without prior intimation to the IO concerned.
vi. Petitioner will mark presence physically before the concerned I.O. every third Friday of the month at 4 p.m., and will be not kept waiting for more than an hour.
vii. Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with any of the prosecution witnesses, the complainant/victim or any member of the complainant/victim's family or tamper with the evidence of the case.
10. Needless to state, but any observation touching the merits of the case is purely for the purposes of deciding the question of grant of bail and shall not be construed as an expression on merits of the matter.
11. Copy of the order be sent to the Jail Superintendent for information and necessary compliance.
12. Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
