Heard the learned Advocates appearing on behalf of the parties. Perused the case diary.
The petitioner is in custody for 2 years 2 months and 19 days. Charge sheet has already been submitted. Charge has also been framed and the trial has already been commenced.
It is submitted by the learned Advocate appearing on behalf of the petitioner that in spite of a direction by a Co-ordinate Bench of this Court by an order dated March 9, 2016 passed in CRM No.11768 of 2015, there has been no progress in the trial from the year 2016.
On the other hand, opposing the prayer for bail, it is submitted by the learned Advocate for the State that 21 Kgs. of Ganja was recovered from the possession of the petitioner, which is above the commercial quantity of 20 Kgs. It is also submitted by him that out of 10 prosecution witnesses, 8 prosecution witnesses have already been examined.
Taking into consideration the above materials in the case, we are not inclined to allow the petitioner's prayer for bail.
Accordingly, such prayer is rejected and the application for bail stands dismissed.
2However, the learned court below is directed to expedite the trial without granting any unnecessary adjournments to either of the parties and to conclude the same expeditiously and preferably within six months.
