Order 06/08/2021 (Downloaded on 07/08/2021 at 08:53:44 PM) (3 of 3) [SAW-1001/2017] We perused an affidavit filed by the respondent State dated 04/02/2021 before this Court under the oath of Mr. Gopal Parihar, SDM, Luni, District Jodhpur.
It is asserted in the said affidavit that the decision No.184 of 2018 based on which the recommendation of the of Previous Cabinet Committee has been approved by the Cabinet stands withdrawn "for review of the same". It is submitted by Shri Joshi, Senior Counsel appearing for the private respondent that the Cabinet Decision referred in the affidavit has never been reviewed nor the same has been withdrawn.
On perusal of the affidavit, we find that it is claimed that by order dated 01/01/2019, the Hon'ble Chief Minister had constituted another three member Cabinet Sub Committee to review the above mentioned decision taken in the past six months of the previous government and the said Sub Committee had also reviewed the decision including the decision No.184 of 2018 regarding the present matter.
The entire record of the so called review as referred to in the affidavit be produced before the Court on the next date of hearing.
Shri Sandeep Shah, learned Additional Advocate General is requested to call for the necessary record and the same will be kept in a sealed cover for production before this Court, if necessary at the time of hearing.
