Through present petition preferred under Section 438 of the Code of Criminal Procedure, Gurpreet Singh @ Babla-petitioner has sought pre-arrest bail, feeling apprehension of his arrest, in case bearing FIR No.23, dated 21.02.2016, under Sections 307, 323, 452, 427, 506, 148, 149 IPC and Section 25/27 Arms Act, Police Station City Dhuri, District Sangrur.
2. At the time of issuance of notice of motion on 20.09.2016, following order was passed by this Court:-
"Inter-alia, it has been contended by learned counsel for the petitioner that it is a case of version and cross version. As per version of the complainant/injured Gurdeep Singh, the role attributed to the petitioner is that he while armed with a stick, dealt its blow on his legs. Learned counsel further contends that co-accused-

Hardeep Singh, who is similarly situated, has already been granted the concession of interim bail vide order dated May 12, 2016 passed by this Court in CRM No.M-16331 of 2016.
Notice of motion for 21.11.2016.
In the meanwhile, petitioner is directed to join the investigation. In the event of arrest, petitioner shall be released on interim bail at the satisfaction of the Arresting Officer/Investigating Officer subject to the conditions envisaged under Section 438(2) Cr.P.C."
3. Learned State counsel on instructions from ASI Gurmit Singh, Police Station Dhuri has submitted that in compliance of order dated 20.09.2016, the petitioner has already joined the investigation and further that he is no more required by the investigating agency for further interrogation/investigation.
4. Taking into consideration the aforesaid aspects of the case but without expressing any opinion on the merits, the petition is allowed and order dated 20.09.2016 is made absolute and shall enure during the pendency of trial but subject to the conditions provided under Section 438 (2) Cr.P.C.
