JUSTICE SABINA Judgment 05/12/2018 Petitioners have filed this petition under Section 438 Code of Criminal Procedure, 1973 seeking anticipatory bail in F.I.R. No. 299/2018 registered at Police Station Sewar, District Bharatpur for offence under Sections 143, 323 & 341 Indian Penal Code, 1860.

Learned counsel for the petitioners has submitted that the present FIR is a counterblast to the FIR Annexure-3 lodged by the petitioners side against the complainant party. Petitioners are ready to join investigation.

Learned state counsel who is assisted by the counsel for the complainant has opposed the petition and has submitted (2 of 2 ) that as per the FIR, petitioners no.1 & 2 had inflicted injuries on the head of injured Dinesh. The said injuries have been described to be likely to be dangerous to life. So far as the petitioner no.3 is concerned, he had inflicted a stick blow on the head of Pintu.

Keeping in view the seriousness of the allegations levelled against the petitioners, no ground for grant of anticipatory bail to them is made out.

Dismissed.
