1. The present application has been filed seeking condonation of delay of 45 days in re-filing the execution petition.
2. Considering the submissions made before this Court, delay of 45 days in re-filing the execution petition is condoned.
3. Application is accordingly disposed of.

4. The present execution petition has been filed under Order XXI Rules 37 and 38 of the Code of Civil Procedure, 1908 ("CPC"), read with Section 36 of the Arbitration and Conciliation Act, 1996 ("Arbitration Act") for execution of the award dated 26th October, 2020, passed by the learned Sole Arbitrator in Arbitration Case No. DAC/1694/05-17, in the matter titled as "Haldiram Snacks Pvt. Ltd. Versus Megha Enterprises and Others".
5. Learned counsel appearing for the decree holder submits that decree holder had earlier filed an execution petition before the Principal Special This is a digitally signed order.

The Order is downloaded from the DHC Server on 21/01/2026 at 20:43:14 Court in Hyderabad. However, the same has been sent back to this Court vide order dated 13th March, 2025, passed by the Principal Special Court in the Cadre of District Judge for Trial and Disposal of Commercial Disputes at Hyderabad, for want of jurisdiction. Hence, the present execution petition has been filed.
6. Issue notice to the judgment debtors by all modes, including, through counsel, who is appearing for the judgment debtors in the appeal under Section 37 of the Arbitration Act.
7. Learned counsel appearing for the decree holder further submits that the petition under Section 34 of the Arbitration Act filed by the judgment debtors already stands dismissed, and an appeal under Section 37 of the Arbitration Act is pending before the Division Bench. However, no stay has been granted by the Division Bench as of now.
8. Accordingly, the judgment debtors shall file their list of assets in terms of Order XXI Rule 41(2), read with Form 16A of Appendix E of CPC.
9. List for hearing on 30th March, 2026.
