As per the observations made in the order dated 05.02.2026, despite service, the respondent did not make appearance on that date. Even today, he has not made appearance. As such, the respondent is proceeded against ex parte.

Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. HMA/467/2025, titled 'Manpreet Singh Vs. Parveen Devi', filed by the respondent-husband, pending in the Family Court, Ambala and she seeks SONU transfer of the same to the Court of competent jurisdiction at Kurukshetra. 2026.02.19 13:59 I attest to the accuracy and authenticity of this document 2 TA-1649-2025 It is submitted by the counsel for the applicant that on account of the matrimonial dispute, the parties are residing separate. The applicant is not having any source of earning and as such, is dependent upon her parental family. Even, she has filed the petition under Section 125 Cr.P.C., which is pending in the Courts at Kurukshetra and the respondent is making appearance in the same. Besides the same, the respondent is facing trial in the Courts at Kurukshetra, relating to FIR bearing No.120 dated 04.03.2021, under Sections 323, 377, 406, 498-A and 506 IPC, got lodged by the applicant at Police Station Krishna Gate, Thanesar, District Kurukshetra.

Counsel submits that earlier also, the repondent had filed a divorce petition in the Courts at Ambala and thereupon, the applicant had filed transfer application i.e. TA-1550-2022, which was allowed vide order dated 15.12.2022, copy whereof is Annexure P-5. Upon transfer of the said divorce petition, the respondent did not make appearance in the same and as such, it was dismissed in default, vide order dated 24.04.2024, copy whereof is Annexure P-6. Also, it is submitted that without seeking setting aside of the dismissal order of the previous divorce petition, the respondent had again filed the second divorce petition at Ambala, though the fact qua the previous divorce petition is disclosed in the same.

Considering the conduct of the respondent, as spelt out aforesaid and taking into consideration the fact of two other litigations, arising from the broken marriage, already pending in the Courts at Kurukshetra, more particularly, the criminal case, wherein the respondent is required to make appearance on each and every date of hearing and above SONU 2026.02.19 13:59 I attest to the accuracy and authenticity of this document 3 TA-1649-2025 all, considering the fact about the respondent having not come forward to resist the application, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/467/2025, titled 'Manpreet Singh Vs. Parveen Devi', filed by the respondent-husband, stands transferred from the Family Court, Ambala, to the Court of competent jurisdiction at Kurukshetra. The requisite record of the aforesaid case be sent by the Family Court, Ambala, to District and Sessions Judge, Kurukshetra.

Learned District and Sessions Judge, Kurukshetra, shall assign the said petition to the Family Court, Kurukshetra. Even, the parties are directed to appear before the Family Court, Kurukshetra, within a period of one month from today onwards.
