Similarly, Opposite Party No.2-wife is represented by Sri Sabyasachi Banerjee, learned Counsel.

Both the parties submit and bring on record a Memorandum of Understanding (for short MOU) dated 10th July, 2015 entered into by and between the petitioner-husband and the opposite party no.2-wife by which the parties have, inter alia, decided to severe their marital ties and settle their disputes on the terms provided in the said MOU. The said MOU is part of the application for divorce by mutual consent 2 filed by the parties under Section 13B of the Hindu Marriage Act, 1955 before the competent Court of the learned District Judge at Alipore.

It is also brought on record by the parties that by the order dated 29th February, 2015, the matrimonial proceeding between the parties being MAT Suit No. 1658 of 2015 (R-1158) was decreed on mutual consent. Such order filed by the parties along with the Section 13B application (supra) with the MOU appended thereto are treated to be on record.

Further taking notice of the compromise entered into between the parties and, as submitted by their learned Counsel, noticing the law settled In Re: Gian Singh vs. State of Punjab reported in (2012) Vol.10 SCC Page-303 the proceedings connected to the complaint Case No. C-8177/13 under the Prevention of Women from Domestic Violence Act, 2005 stands quashed.

Having regard to the entirety of the above noted facts, C.R.R. Nos. 1719, 3818 and 1028 of 2015 along with the connected CRAN No. 290 of 2015 stand accordingly disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the learned Counsel for the parties upon compliance of necessary formalities.
