Notice of motion.

On the asking of the Court, Mr. Namit Kumar, Advocate, Mr. Jagmohan Ghumman, DAG, Punjab, and Mr. D.K. Singal, Advocate, accept notice on behalf of respondent No. 1; respondent Nos. 2 to 4; and respondent No. 5, respectively. Copies of the writ petition furnished.

For the nature of the order I propose to pass in the matter, no formal written statement/counter affidavit is indeed necessary on behalf of the respondents, at this stage. Thus, with the consent of the parties, the petition is being disposed of finally.

The limited grievance that the petitioner has is; that her land holding was acquired by the respondents under the National Highways Act, 1956. And, vide Award No. 1010, dated 03.06.2016 (Annexure P-2), the competent authority had assessed the market value of the acquired land. Although, a considerable time has elapsed, but the petitioner has not been 1 of 2 ::: Downloaded on - 27-09-2017 02:31:09 ::: CWP-21670-2017 2 disbursed compensation in terms of the award, dated 03.06.2016 (Annexure P-2). So much so, the legal notice, dated 26.08.2016 (Annexure P-4), served upon the respondents in this regard, has failed to evoke any response.

Learned counsel for the respondents submit that the claim of the petitioner as also the notice served on her behalf, dated 26.08.2016 (Annexure P-4), shall be considered and decided within a period of four weeks from today and necessary order shall be passed.

Accordingly, the petition is disposed of in the above terms. Needless to assert that in the absence of any justifiable ground, the competent authority shall release the compensation to the petitioner without any further delay.
