JUDGMENT(ORAL)
1. The short grievance as projected by the petitioner in this petition is that he is posted as Assistant Manager Passenger Service in J&K Road Transport Corporation (JKRTC). He is a patient of Chronic Renal Failure and claims that he is not in a position to travel or even drive. He is aggrieved of his transfer order issued by Managing Director, JKRTC whereby he has been transferred and posted as Depot Manager, Udhampur.
2. Having heard learned counsel for the petitioner and perused the record, I am of the view that the matter has to be reconsidered by the Managing Director of the Corporation, keeping in view the medical condition of the petitioner. It would be appropriate if the petitioner is got medically examined by the Medical Board at Government Medical College, Jammu for its opinion. The 2 WP (C) No. 293/2020 Managing Director shall pass appropriate orders thereafter based on the medical opinion.
3. It is made clear that in case pursuant to the opinion provided by the Medical Board, it is found that the petitioner is fit to perform his duties at Udhampur, the order impugned will remain intact, else the Managing Director of the Corporation shall pass appropriate orders of posting of the petitioner keeping in view the opinion of Medical Board. Till a decision in this regard is taken by the Managing Director, the petitioner's present position at Jammu shall be maintained.
4. The writ petition is accordingly, disposed of.
