Navi Mumbai vs. Hindustan Petroleum Corporation Ltd. 2019 (369) E.L.T. 579 (Bom.) that has been referred to a Larger Bench would have bearing on the present appeal. It is informed that the said reference is still not answered.

In view of aforesaid the present proceedings are adjourned sine die with liberty to the parties to apply if the reference is answered by the Larger bench.
