Information sought:
1. The Appellant filed an RTI application dated 01-12-2024 seeking the following information:
"(1) Rajasthan patrika is a leading newspaper widely distributed in rajasthan. (2)It is mendatory (for the every newspaper) to disclose name & designation of editor, chief editor etc as per PRB (The press and registration of BOOK) act (3)Please provide name of editor and thief editor of RAJASTHAN PATRIKA in the month of augest 2008, sept 2008 with proper identification of person like name alongwith father name etc. (4)I need this information with reference to time/month/year as mentioned above in point number 3.
(5) Please send this information as hard copy as well."
2. The CPIO furnished a reply to the Appellant on 24-12-2024 stating as under:
" 2. आपके द्वारा माांगी गई सूचना के सांदर्भ में आपको सूचचत ककया जाता है कक जजन शीर्भक कक जानकारी आप चाहते है उन शीर्भक से आप ककसी र्ी तरह से सम्बांचित नहीां है अथवा सत्यापपत/पांजीकृत शीर्भकों के लिए सावभजननक रूप में उपिब्ि जानकारी इस लिांक http://rni.nic.in/verified_titles/verified_titles.aspx पर दे खी जा सकती है।"
3. Being dissatisfied, the Appellant filed a First Appeal dated 18-12-2024. The FAA vide its order dated 17-01-2025, held as under:
CIC/RNIND/A/2025/603285 Page 2 of 5"कृप्या अपनी अपीि सांख्याओां RNIND/A/E/24/00076 एवं RNIND/A/E/24/00077 ददनाांक 18.12.2024 का अविोकन करें । इस सांदर्भ में आपको बताया जाता है कक सूचना का अचिकार अचिननयम, 2005 की िारा 8 (1) (1) के अांदर माांगी गई सूचना उपिब्ि नहीां कराई जा सकती है। xx जजन तारीखों (अगस्त 2008 और लसतम्बर 2008) के अखबारों का आपके द्वारा उल्िेख ककया गया है, वह कायाभिय में उपिब्ि नहीां है।"
4. Feeling aggrieved and dissatisfied, Appellant approached the Commission with the instant Second Appeal.

The following were present:-
Appellant: Absent.
Respondent: Mr. Sher Singh, Section Officer along with Mr. Harsh, ASO, attended the hearing in person.

The Respondent submitted that the appellant sought information regarding name of editor and chief editor of RAJASTHAN PATRIKA which is part of mandatory disclosure under PRB Act, for the months of August, 2008 and September 2008 along with their father name etc. The respondent submitted that the sought details regarding father's name is exempted U/s 8(1)(j) of the RTI Act.

Decision:

The Commission, after adverting to the facts and circumstances of the case, hearing the respondent and perusal of the records, observes that, the appellant sought information regarding name of editor and chief editor of RAJASTHAN PATRIKA which is part of mandatory disclosure under PRB Act, and the respondent ought to have provided the same. Also, the name of the father of the editor and chief editor are exempted U/s 8(1)(j) of the RTI Act, 2005 and the respondent's contention is upheld in this regard. The respondent is accordingly directed to provide a revised reply to the appellant, incorporating only the names of the editor and chief editor of RAJASTHAN PATRIKA for the sought period. The respondent shall provide the aforesaid revised reply to the appellant, within 15 days from the date of receipt of this order under intimation to the Commission - both through post and via uploading on http://dsscic.nic.in/online-link-paper-compliance/add. Accordingly, the appeal is disposed of.
Copy of the decision be provided free of cost to the parties.
