Petitioners are seeking regular bail in a case registered against them under Sections 307, 452, 382, 323, 324, 148, 149 IPC at Police Station City Malout, District Muktsar, vide FIR No.51 dated 17th April, 2009.

Learned counsel for the petitioners submits that no injury allegedly caused by the petitioners, can be said to be dangerous to life. According to the learned counsel, petitioners are in custody since 17th April, 2009. Investigation of the case has been completed and as such, no useful purpose will be served by keeping the petitioners in custody during pendency of the trial.

Learned counsel for the State, on the instructions from ASI Puran Chand (who is present in court), states that challan has been presented in the competent court of jurisdiction and the offences under CRM No. M-17286 of 2009 2 Sections 307, 452 IPC have been deleted as no offence under the said Sections are found to be made out. However, learned State counsel has opposed the bail on the ground that the allegations against the petitioners are serious in nature.

Keeping in view the facts and circumstances of the case and the fact that the petitioners have been in custody since 17th April, 2009, no useful purpose will be served by detaining the petitioners in custody during the pendency of the trial as the trial may take long time to conclude. So, without expressing any opinion on the merits of the case, this petition is allowed and the petitioners, namely, Manpreet Singh, Ruby Brar alias Sukhjinder Singh and Simarjit Singh are directed to be released on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Muktsar.
