% 05.05.2022 The proceedings in the matter have been conducted through video conferencing.

1. By way of this application under Section 439 of the Code of Criminal Procedure, 1973, the applicant seeks interim bail for a period of sixty days on the ground of ill health of his mother.

2. It is contended in the application that the applicant's mother was admitted to the Intensive Care Unit at Universal Hospital, Badarpur, New Delhi, on 04.03.2022. Although she was discharged on 15.03.2022, Mr. Asaf Ali, learned counsel for the applicant, states that she has been under regular treatment thereafter and has been advised surgery. He submits that the presence of the applicant is required for making arrangement of funds and to attend to his mother at the time of surgery.

3. Mr. Amit Chadha, learned Additional Public Prosecutor for the State, draws my attention to the order of the Sessions Court dated 22.03.2022, by which the interim bail application of the applicant was rejected on the ground that his mother's condition is now stable and that she has been advised from time to time to have the required surgery but has not done so.

4. Mr. Ali states that surgery has been advised after the filing of the bail application. He seeks one week's time for filing further medical documents.

5. Further medical documents may be filed by 09.05.2022. A copy of the documents will also be served upon Mr. Chadha.

6. Status report be filed within one week thereafter.

7. List on 26.05.2022.
