                                 ORDER

1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO) Bank of Baroda, Coimbatore, Tamil Nadu Nadu. The appellant seeking information is as under:-

2. The CPIO vide letter dated 22-04-2020 has provided point-wise wise reply to the appellant. Being dissatisfied with the same, the appellant has filed file first appeal dated 25-04-2020and and requested that the information should be provided to him. The FAOO is not placed on records records. He has filed a second appeal before the Commission on the ground that information sought has not been provided to himand requested to direct the respondent to provide complete and correct information.

Hearing:

3. The appellant attended the hearing through video-conferencing conferencing. The respondent, Shri K Sarvakumar Sarvakumar, CPIO/Regional Manager attended the hearing through video-conferencing..

The appellant reiterated the contents of his RTI Application and submitted that the complete information has not been provided to him by the respondent on his RTI application dated 22.03.2020 22.03.2020. He further submitted that he is not satisfied with the reply provided w.r.t point no. 4 of RTI Application.

The respondent submitted that vide their letter dated 22.04.2020, 22.04.2020 in response to pointt no. 4 of RTI application; they have informed the appellant that "the non CTS clearing is held only once a week. The cheque received on 23.07.2018 was presented on the next available non CTS clearing on 02.08.2018 and returned unpaid on the same day." Therefore relevant reply as day."Therefore per their records has already been provided to the appellant well within stipulated time period as per the provisions of the RTI Act, 2005.

Decision:

The Commission, after hearing the submissions of both the parties and after perusal erusal of records, observes that the appellant has sought information regarding the challan submitted in respondent's bank on 16.07.2018 and other queries related thereto. The appellant is aggrieved with the reply provided on point no. 4 of RTI Application Application.. In this regard, the Commission is of the view that the appellant has sought the copy of the challan and documents relating to Page 2 of 3 submission of the cheque (with date) i.e. non-CTS cheque for collection to the Indusind Bank, Avinashi Road branch on this point. But, instead of providing the relevant document, the respondent has provided the explanation to the appellant, which is not required as per the provisions of the RTI Act, 2005.

In view of the above, the Commission deems it fit to direct the respondent to provide a revised reply on point no. 4 of RTI Application vide which copy of relevant documents/ internal guidelines/ circulars covering the information sought on this point should be provided to the appellant within 15 days from the date of receipt of copy of this order.

8. With the above observations, the appeal is disposed of.

9. Copy of the decision be provided free of cost to the parties.
