On 16.9.2008 the petitioners who are members of the Sugar Mill Association had been protesting near the Section 16 Stadium, Chandigarh, on account of the fact that they are not being released their salary for 22 months. On account of a scuffle took place in the agitation they were arrested and FIR No. 502 dated 16.9.2008 under Sections 147, 149, 332, 353, 188 IPC was registered at Police Station, Sector 17, Chandigarh. Challan was presented by the police on 15.12.2009 and thereafter charges were framed on Crl. Misc. No. M-16198 of 2012 (O&M) [ 2 ] 14.1.2010. The petitioners are appearing before the Court for the last 32 months regularly.

The agitation which took place on 16.9.2008 was led by Karnail Singh, President of the Sugar Mill Workers Union along with 400-500 workers. The petitioners have been arrested and are facing the trial.

This criminal miscellaneous petition is being disposed of at this stage to enable the petitioners to take all the pleas before the trial Court. Personal appearance of the petitioners before the trial Court is exempted subject to the following conditions:- (i) petitioners shall be represented through their counsel; (ii) shall not delay/stall the trial proceedings; (iii) shall not dispute their identity as accused;

(iv) shall have no objection if the prosecution evidence is recorded in their absence but in the presence of their counsel; (v) shall appear before the trial Court as and when required by the trial Court; and (vi) any other condition which the learned trial Court may impose.
