The Hon'ble Justice Pinaki Chandra Ghose And The Hon'ble Justice Sankar Prasad Mitra Date. 12.5.2008 The Court: We have perused the order passed by the Tribunal. It appears that the Tribunal has extensively dealt with the matter. We do not find that any substantial question of law is involved which is required to be decided by this Court. Furthermore the amount of tax effect is much less than Rs.4 lacs which is hit by the CBDT circular dated 30th November, 2005, which stands in the way of admitting the application. We, therefore, do not find any reason to admit the application being ITA No.180 of 1999.
In our opinion it is not necessary for this bench to answer the Rule which has been issued. Hence Rule is discharged and application is dismissed.2
All parties concerned are to act on a xerox signed copy of this order on the usual undertakings. Urgent xerox certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
