Facts: i
1. The appeal was scheduled for hearing on April 9, 2010. While the CPIO along with his colleagues appeared for hearing, the appellant informed in writing that he has settled his dispute with the concerned agency (LPG dealer) and therefore he has no more interested in pursuing the matter with the Commission.
2. The CPIO stated that the appellant has been trying to promote his personal interest through putting up several RTI applications from time to time against a dealer for which he was working. Specifically, the CPIO stated as under:
"In this regard, we would like to bring into your kind notice that the RTI applicant, Sh. Satish Chandra Tiwari was earlier working as a delivery man for distribution of LPG cylinders with one of our LPG distributorships, M/s Bakson Gas Service, Opposite Jhandewalan Mandir, Adjoining Janta Market, New Delhi. His services were terminated by the distributor due to his alleged involvement in various malpractices in distribution of LPG cylinders. As a result, Sh. Satish Chandra Tiwari has been complaining again and against M/s Bakson Gas Service with malafied intentions and even resorted to mis-use of the RTI Act 2005."
Decision:
3. It is indeed very unfortunate that a large number of persons who themselves are not so clean in so far as their conduct and behaviour, including economic integrity is concerned; and, it is they who have been misusing the provisions of the RTI Act for promotion of personal interest at the heavy cost of i "If you don't ask, you don't get." - Mahatma Gandhi 1 public expenditure which are incurred in processing the RTI applications. The instant case is a fit example of such misuse of the provisions of the RTI Act.
4. Now since the appellant has already chosen to withdraw his appeal, after imposing unnecessary costs to the public authorities, we have no option but to dismiss the appeal with a deep sense of regret that we are unable to sufficiently educate such people.
5. With these observations, the case is closed.
