WRIT PETITION No.41401 of 2015
ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief:
"....to issue an appropriate writ direction or order more particularly one in the nature of Writ of Prohibition declaring the proceedings of the Respondent No.2 in ID note dated 27.11.2015, rejecting the representation of the Petitioner dated 07.05.2015 as communicated by the Responder No.1 vide its proceedings in Ref: NFC/IRO/12/02 dated 10.12.201i5 as illegal, arbitrary and contrary to CCS (RSA) Rules 1993 and it is further consequentially prayed that this Hon'ble Court may be pleased to set aside both the said communication of the Respondent No.2 and 1 and it is further consequentially prayed that this Hon'ble Court may be pleased to declare the action of the Respondent 1 and 2 permitting the 62 Scientific Assts., the members of the Writ Petitioner Association, to be the members of the 3rd Respondent Association, ignoring the necessity for their inclusion in the Writ Petitioner Association only, as illegal, arbitrary and violating the RSA Rules, 1993 under which the exclusive Writ Petitioner Association came into being and it is further consequentially prayed that this Hon'ble Court may be pleased to direct the Respondent No.1 and 2 not to permit any Scientific Assts. to be the members of any other Association under the Respondent No.1 than the Writ Petitioners Association only and to pass......"
2. This Writ Petition is pending on the file of this Court since 2015. Even after receipt of notice, the respondents have not filed counter affidavit.
3. Learned counsel for the respondents submitted that pending adjudication of the writ petition, petitioner- 2 association, represented by its General Secretary, addressed a letter vide Ref: NFC/NFCSAA/Gen- Sec/15/2016, dated 23.04.2016, to the respondents stating that they have decided to withdraw the writ petition. The same is placed before this Court.
4. Today, when the matter is taken up for hearing, there is no representation for the petitioner, which shows that the petitioner is not interested to pursue the writ petition.
5. Taking on record the said letter dated 23.04.2016 addressed by the petitioner to the respondents and since there is no representation on behalf of the petitioner, this Writ Petition is dismissed as withdrawn. However, it is left open to the petitioner to file appropriate application, if any cause survives. No costs.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
