Background

1. The Applicant filed an RTI application dt.30.9.08 with the CPIO, BSNL, Mainpuri. He requested for information against 15 points. The CPIO replied on 20.10.08 stating that since the information is voluminous and is not available in the format in which it is being sought and since there is shortage of staff, the Applicant is invited on any working day between 10 a.m. and 5 p.m. to the office to inspect the files and to take certified copies of whatever information he requires after depositing the requisite fee for photocopying. The Applicant then filed an appeal before the Appellate Authority and on not receiving any reply, he filed a second appeal dt.15.11.08 before the CIC.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for March 16, 2009.

3. Mr. Babu Ram, T.D.M, Mainpuri & CPIO represented the Public Authority.

4. The Applicant's representative Mr. R.K. Singh, Adv. was present during the hearing.

Decision

5. The Respondent submitted that since the information is voluminous and is not available in the format in which it is being sought and since there is shortage of staff, the Applicant is invited on any working day between 10am and 5pm in office to inspect the files and take certified copies of whatever information he requires after depositing the requisite fee for copies. The Appellant. However, submitted that he has not received this letter inviting him to inspect the files. Based on the submissions of the two parties, the Commission directs the CPIO to allow inspection of files by the Appellant before the 31st of March, 2009 preferably on 24th and 25th March, 2009 from 10.00 a.m to 5.00 p.m. and to provide him with certified copies of the information he requires on payment of requisite amount of fees.

6. The appeal is disposed off.
