(2)If the Chief Inspector is satisfied that the plans are in consonance with the requirements of the Act, he shall, subject to such conditions as he may specify, approve them by signing and returning to the applicant one copy of each plan or he may call for such other particulars as he may require to enable such approval to be given:[Provided that no such approval shall be given in respect of the site of any factory referred to in the proviso to sub-rule (1) unless the Chief Inspector of Factories and the District Magistrate concerned have personally visited the site of the factory and have approved the same, and in case of any difference of opinion among the authorities regarding the location of the plant the matter shall be referred to the State Government for decision:Provided further that no place shall be disapproved unless the applicant is given an opportunity to be heard and the Chief Inspector or as the case may be the State Government has recorded its reasons in that behalf] [Added by G.N., of 24th May, 1969]
