Section 14 in Treaty on Extradition between the Republic of India and the Federative Republic of Brazil
14. Capital Punishment.
If under the law of the Requesting Party the person sought is liable to the death penalty for the crime for which his/ her extradition is requested, but the law of the Requested Party does not provide for the death penalty in a similar case, extradition may be refused unless the Requesting Party gives such assurance as the Requested Party considers sufficient that the death penalty will not be carried out.Article 15
