ORDER
1. By this Execution Application (EA), applicant is seeking compliance of the order dated 25.02.2025 passed in OA No.678/2023.
2. In the OA, applicant had raised the grievance about improper management of dhalao at Block no. H&D, Jangpura Extension.
3. Municipal Corporation, Delhi (MCD) had filed the reply to the OA taking the stand that collection of municipal solid waste in the subject dhalao was stopped from 20.02.2025, therefore, OA was disposed of by order dated 25.02.2025 directing the MCD to ensure that no garbage is dumped at the site of the closed dhalao of H and D Blocks.
4. In this EA, MCD had filed reply dated 16.05.2025 disclosing as under:-

"That with regard to the additional affidavit filed by the applicant on dated 22.04.2025 along with certain photographs of the H&D Block closed dhalaos, it is submitted that it has been noticed that sometimes residents/people used to dump the garbage at these closed dhalaos during odd hours even after closing of the dhalaos. In that respect the concerned concessionaire has been directed vide this officer letter no. EE (EMS) CNZ/MCD/2025-26/27 dated 16.04.2025 (Copy annexed as Annexure -(Copy annexed as Annexure B) to keep regular watch and make it A) & letter no. EE (EMS) CNZ/MCD/2025-26/43 dated 25.04.2025 immediately clean on regular basis, if any garbage is found dumped. Notice board has also been displayed at both of these closed dhalaos informing to general public that the garbage collection has been completely stopped at these dhalaos and a Portable Compactor Transfer Station (PCTS) has been made operational near JE (Works) Store in Pant Nagar for garbage collection in place of these dhalaos. M/s DDSIL has replied the above letters vide letter no.
DDSIL/CNZ/2443/2025 dated 21.04.2025 & letter no. DDSIL/CNZ/2448/2025 dated 03.05.2025 (Copies annexed as Annexure - C) and ensured for compliance for the Hon'ble NGT directions. M/s DDSIL submitted that garbage is being dumped at these sites, during night odd hours, sign board has already been installed, Information, Education, and Communication (IEC) activities are being conducted regularly in coordination with MCD officials to spread awareness among Rag Pickers, Sanitation Works, RWAs and General Public to stop dumping of garbage at these closed dhalaos. The photographs of the closed dhalaos of H&D block of Jangpura Extension (Copy annexed as Annexure - D). That departmental staff has also been deputed from 06:00AM to 10:00PM vide office order no. 123/AC/DEMS/CNZ/2024-25 dated 08.05.2025 (Copy annexed as Annexure E) issued by Assistant Commissioner/CNZ, to keep proper watch & ward at these H&D Block closed dhalaos, to stop the dumping of garbage by the general public/any garbage generator at these sites. That it is respectfully submitted that all out endeavors are being made by the department for proper operation and maintenance of newly constructed PCTS in Pant Nagar as well as to stop the dumping of MSW at H&D block closed dhalaos of Jangpura Extension."

In terms of the above disclosure, MCD is taking steps to clean the dhalao on regular basis and has stopped dumping of garbage in that dhalao and MCD has also deputed staff from 6:00 AM to 10:00 PM to keep a proper watch on H&D block post dhalao to stop dumping of garbage by general public/any garbage generator at the site in question. 2
6. Applicant thereafter had filed affidavit dated 13.10.2025 enclosing therewith certain photographs showing that some garbage was dumped at the dhalao. Therefore, responding to it, MCD has filed affidavit dated 14.10.2025 disclosing the action taken as under:
"That with regard to the additional affidavit filed by the applicant on dated 09.07.2025 along with certain photographs of the H&D Block closed dhalaos, it is submitted that it has been noticed that sometimes residents/people used to dump the garbage at these closed dhalaos during odd hours even after closing of the dhalaos.. Notice board has been displayed at both of these closed dhalaos informing to general public that the garbage collection has been completely stopped at these dhalaos anda Portable Compactor Transfer Station (PCTS) has been made operational near JE (Works) Store in Pant Nagar for garbage collection in place of these dhalaos. That departmental staff has also been deputed from 06:00AM to 10:00PM vide office order no. 123/AC/DEMS/CNZ/2024-25 dated 08.05.2025 (Copy annexed as Annexure A) issued by Assistant Commissioner/CNZ, to keep proper watch & ward at these H&D Block closed dhalaos, to stop the dumping of garbage by the general public/any garbage generator at these sites.
That all concerned field staff of the Jangpura area has been directed to keep proper watch on the H&D Block closed dhalaos to avoid the illegal dumping of work at these dhalao. Now the garbage is not being dumped at these sites and if it is found any garbage dumped at these site even in odd hours the same got cleaned on priority by the concerned staff. The photographs of these sites (closed dhalaos of H&D Block) have been taken and annexed as Annexure - B. That it is respectfully submitted that all out endeavors are being made by the department for proper operation and maintenance of newly constructed PCTS in Pant Nagar as well as to stop the dumping of MSW at H&D block closed dhalaos of Jangpura Extension."

Learned Counsel for the applicant has placed reliance upon, photographs subsequently filed along with additional affidavit dated 17.12.2025 in support of the plea that garbage is still dumped at the dhalao but this aspect has been clarified by Counsel for the MCD by referring to the photographs of the same date placed on record along with affidavit of MCD dated 16.12.2025 and pointed out that photographs relied upon by Counsel for the applicant were taken up early in the morning but thereafter garbage was cleaned on the same day immediately. 3
8. Thus, we find that order of the Tribunal has been duly complied with by the MCD. It is the applicant's own case in this EA that countless negligent people in the society despite of the public announcement by the MCD that dhalao has been shut, continued to dump their waste in the dhalao. Therefore, for such an act, MCD cannot be blamed for non- compliance of the order of the Tribunal.
9. Needless to say, in such circumstance, awareness needs to be created amongst the local residents by the applicant himself or concerned resident welfare society.
10. Since, MCD is taking prompt action to comply with the order of the Tribunal, therefore, no further direction in this EA is required which is accordingly disposed of.
