O R D E R (ORAL)
Hon'ble Mr. R N Singh, Member (J) :-
The applicants have filed MA No.1038/2022, praying therein for the following relief(s) :-
"(1) Take the aforesaid OM No. F.No. C-
18012/03/2015 Ad-IIB dated 24th March, 2022 on record and dispose of the OA No.527/2019 by preponing the date of hearing with directions to the respondents to grant promotion to the applicants to the post of Supdt. (GST) from the date of promotion of their juniors as per aforesaid OM dated 24.03.2022 in time bound manner.
(2) Pass any other further order which may be deemed fit and proper in the facts of the case."
2. Issue notice. Shri Rajeev Kumar, learned counsel, who appears for the respondents on advance service, accepts notice.
3. For the reasons given therein and keeping in view no objection from the learned counsel for the respondents, the MA is allowed. The Circular dated 24.03.2022 is taken on record and with the consent of the learned counsels for the parties, the matter has been taken up for final disposal. 26 Item 81 O.A. No.527/2019
4. Pleadings in the OA are complete. The OA has been filed under Section 19 of the Administrative Tribunals Act, 1985, praying therein for the following relief(s) :-
"i) To direct the respondents to consider the applicants for promotion to the post of Superintendent Central Excise by granting them relaxation upto 02 years in eligibility service prescribed in RRs as per O.M. dated 25.03.1996 and grant them promotion from the date/dates of promotion of their immediate junior with all consequential benefits of pay fixation and seniority.
ii) To quash and set aside the impugned orders dated 12.04.2018 & 11.05.2018 (A-1 Colly) issued by respondents in respect of all the applicants and direct the respondents to consider the applicants claim for promotion to the said post of Superintendent, Central Excise by giving relaxation of two years of service as per DOP&T OM no. AB-14017/12/88-Estt. (RR) dated 25.03.1996 and the law on the subject with all consequential benefits by holding Review DPCs.
iii) To direct the respondents to extend the benefits of order passed in OAs No.3405/2014, 2450/2016 & 1923/2016 to the applicants and grant them promotion to the post of Superintendent, Central Excise from the date of promotion of juniors and completion of 6 years of service i.e. 01.04.2016/ 01.04.2017 with all consequential benefits.
iv) To allow the OA with costs.27

v) Any other relief's as this Hon'ble Tribunal may deem fit and proper in the facts and circumstances of the case to meet the ends of justice."

Learned counsel for the applicants submits that the relief sought by the applicants is supported by the order passed by this Tribunal vide order/judgment dated 12.05.2016 in OA No.3405/2014 titled Pankaj Nayan & Ors. Vs.UOI & Ors. (Annexure-A/5), upheld by the Hon'ble High Court of Delhi. Learned counsel for the applicants further submits that during the pendency of the OA, the respondents have issued Circular dated 24.03.2022, whereby they have taken a decision to extend the benefit of the order/judgment dated 12.05.2016 in the case of Pankaj Nayan (supra) to the similarly situated persons.

Shri Rajeev Kumar, learned counsel for the respondents submits that once a policy decision has been taken by the respondents vide the aforesaid Circular dated 24.03.2022 (Annexure-M/1), the present OA may be disposed of, with direction to the respondents to extend benefit of aforesaid policy decision to the similarly placed persons in a time bound manner, inasmuch as, the 28 Item 81 O.A. No.527/2019 respondents themselves indicated in the said policy decision to grant the extension of the benefit of the order/judgment of this Tribunal in Pankaj Nayan's case (supra) to similarly situated persons.

Shri Bhardwaj, learned counsel for the applicants submits that in the identical matter, Hon'ble High Court of Delhi vide order dated 07.04.2022 in WP(C) No.1309/2019 has directed the respondents to extend the benefit of the aforesaid policy decision of the respondents to the applicants therein, within 45 days. On the other hand, learned counsel for the respondents submits that they have not yet received a copy of the said order/judgment dated 07.04.2022.
8. We have heard the learned counsels for the parties and perused the order of the Hon'ble High Court of Delhi dated 07.04.2022. The said order reads as under :-
1. The petitioner's have sought identical reliefs as was given to Pankaj Nayan & Ors in OA No. 3405/2014. The Ministry of Finance has issued an Office Memorandum dated 24.03.2022 extending the benefit inter alia as under:
'... 3. In order to minimize these litigation, a decision has been taken to extend the benefit of Order dt. 12.05.2016 of Hon'ble CAT, New 29 Item 81 O.A. No.527/2019 Delhi in OA no. 3405/2014 filed by Sh. Pankaj Nayan & Ors to all similarly situated persons (petitioners and nonpetitioners) w.e.f. 14.10.2014 i.e. date of review DPC in view of the said judgment of Pankaj Nayan. The Sr/Jr. clause was inserted in Recruitment Rules of Superintendent ( Central Excise) and Superintendent (Customs Preventive) on 13.12.2018 and 10.6.2019 respective.
5. Keeping in view the above and as a first step towards such a review, zones are advised to carry out an impact analysis of in -rem extension of Pankaj Nayan judgment. Any issue arising thereof may be intimated to the Board for resolution. A report on the impact analysis may be sent to the Board within a month of issue of this letter. A one day workshop will be held thereafter with all CCAS, to address their queries on the matter. ...'
2. The respondent's endeavour to review and to carry out the impact analysis of the zones in terms of the extension being given according to the judgment in Pankaj Nayan & Ors, may well seek to qualify the benefit extended to the petitioners.
3. In so far as the objective of the Government's decision to extend the benefits of Pankaj Nayan & Ors to the petitioners is unqualified, let the same be made available to them preferably within a period of 45 days.
4. All parties including those impleaded in CM 9136/2019 & 9138/2019 in this Writ Petition, would also be extended the same benefits.30

5. The petition is disposed off in the aforesaid terms.
6. It will be open to the parties to approach the court in case of any difficulty."
9. In the facts and circumstances and with the consent of the learned counsels for the parties, the present OA is disposed of, with direction to the respondents to consider the claim of the applicants, in the light of the aforesaid policy decision dated 24.03.2022 and to pass an appropriate order as expeditiously as possible and preferably within six weeks from the date of receipt of a copy of this order.
10. The OA is disposed of in the aforesaid terms.
Pending MAs, if any, shall stand disposed of. There shall be no order as to costs.
