1. Allowed, subject to just exceptions and as per extant rules.

2. The applications are disposed of.

3. The petitioner in each of these petitions is a retired personnel of the respondent Central Reserve Police Force (CRPF).

4. The counsel for the petitioners states that (a) the claim in W.P.(C) No.8003/2020 is for grant of benefit of first financial upgradation under the Assured Career Progression Scheme (ACP) and second financial upgradation of Modified Assured Career Progression Scheme (MACP) in fixation of pension; and, (b) the claim in W.P.(C) W.P.(C) Nos.8003/2020 & 8004/2020 Page 1 of 2 No.8004/2020 is for second and third financial upgradation of MACP, together with arrears of pay and arrears of pension re-fixed on the said premise.

5. Attention has been drawn to orders passed in other petitions including to the effect that the respondents CRPF should grant the benefit allowed by the Court in other petitions, to all others similarly placed and it is stated that though the petitioners, similarly placed, got issued a legal notice but have been compelled to come to the Court.

6. Unfortunately, again no reasons are given in response to any of the communications preceding the petitions, as to why the relief sought is being denied.

7. The counsels for the respondents CRPF appearing on advance notice need time to obtain instructions.

8. Issue notice.

9. Notice is accepted by the counsels for the respondents CRPF.

10. Counter affidavits be filed within six weeks.

11. If the orders / judgments passed in other cases are not applicable to the petitioners and the petitioners are not entitled to benefit thereof, the same be communicated to the petitioners, setting out the reasons thereof. Else, we expect the benefits, if any due to the petitioners to be released by the next date of hearing failing which, direction for release thereof shall be made, together with direction for payment of interest on arrears.
