The Original Applications having been heard on 25.09.2023, the
Tribunal on the same day delivered the following:
O R D E R (Oral):-
Per: Mr. Justice Sunil Thomas, Judicial Member The applicants in O.A Nos. 236/2021 and 252/2021 are posted at Palakkad and the applicant in O.A No. 244/2021 is posted at Trivandrum as Chief Loco Inspectors. They claim stepping up on the ground that their common junior has started getting more salary than them. To supplement their contention they rely on Annexure A-14 to Annexure A-17 orders produced in O.A No. 236/2021, issued by Salem Division in identical cases. The applicants in O.A Nos. 193/2021, 196/2021 and 197/2021 are aggrieved by the proposed withdrawal of the financial upgradation granted to them. They contended that they are also entitled for stepping up as they are similarly situated with that of their counter parts in Salem Division. Considering the long pendency of the matters and apprehending that the pendency of challenge to the withdrawal of the MACP is delaying the claim for stepping up, on an evaluation of the entire facts, they submit that they are ready and willing to give up their challenge to the recovery of financial upgradation given to them. However, they also submit that their claim for stepping up may be granted. We also take note of the fact that however, applicants in 196/2021 and 197/2021 have not specifically prayed for stepping up. 9 O.A. No. 236/2021 & C.cases
2. After hearing the learned counsel on both sides in extenso, we find that since stepping up has been granted by virtue of Annexure A-14 to A-17 by the Salem Division, which also comes under Southern Railway as that of Palakkad and Trivandrum Division, similarly situated applicants are also entitled for that benefit. Hence, it will be just and proper to give a direction to the respondent Railways at Trivandrum and Palakkad Division to grant the applicants herein the benefit of stepping up. If the applicants in O.A Nos. 196/2021 and 197/2021 have not applied for stepping up, they shall submit a representation, claiming stepping up and detailing the facts which entitle them to the benefit of stepping up, within a period of one month from today. Accordingly, the Railways shall issue orders granting them stepping up within a period of three months from the date of receipt of a copy of this order, or within a period of three months from the date of receipt of representation, as the case may be. The entire amount due shall also be paid within the said three months, after adjusting the over payments, if any.
3. The above O.As are disposed of as above. No costs.
