ORDER
Hon'ble Ms. Harvinder Kaur Oberoi, Member (J):
Since the issue in all these Original Applications is same, we propose to decide all the captioned OAs by this common order. However, for writing the present order, the facts are being taken from OA No. 478/2024 (Vijendra Singh) treating the same as the lead case.
2. The applicant is a citizen of India and is entitled to all fundamental rights guaranteed under the Constitution of India. The applicant was appointed as Constable (Executive) in Delhi Police on 09.01.2010 and has since discharged his duties with utmost sincerity and dedication. Owing to his hard work and performance, he was promoted to the rank of Head Constable (Executive) on 30.12.2020. While serving as Head Constable, the applicant demonstrated exceptional devotion to duty by recovering 78 missing persons, including 41 children below the age of 14 years, 36 between the ages of 14 and 18 years, and one person above 18 years, within a short span of five months and nine days from 23.04.2022 to 02.10.2022, while posted at Police Station INA Metro, Delhi. His efforts were formally recognized through a citation dated 19.10.2022.

These standing orders provide that a Constable or Head Constable who recovers 60 or more missing children below 18 years, including at least 25 below 14 years, within 12 months, is eligible for consideration for out-of-turn promotion subject to availability of vacancies. The applicant fulfilled all eligibility criteria, was clear from vigilance angle, had no pending disciplinary or criminal proceedings, had not suffered any major penalty in the preceding three years or minor penalty in the last six months, and maintained consistently good to outstanding ACRs without adverse entries. His name was never included in any list of doubtful integrity, nor was he ever convicted of any offence involving moral turpitude.
4. The file pertaining to the applicant was duly processed and forwarded by the competent authorities on 20.10.2022. However, despite established practice of conducting an Incentive Committee meeting annually, no such meeting was held for the vacancy year 2022, even though more than 18 vacancies of Assistant Sub- Inspector under the out-of-turn promotion quota were available. Instead, the respondents deviated from established practice without justification and clubbed cases of 2022 and 2023 by calling for additional files of officers recommended in 2023. A combined Incentive Committee meeting was eventually held on 09.11.2023.
5. Pursuant to this meeting, promotions were granted on 11.11.2023 to several candidates, including those recommended later than the applicant, such as Rinku Singh and others recommended in 2023, while the applicant was ignored. The respondents thus failed to consider the applicant's case in its proper chronological order and deprived him of promotion despite his superior and qualifying achievements.

The counsel for the applicant submits that the impugned action of the respondents is violative of Articles 14 and 16 of the Constitution of India, being arbitrary, discriminatory, and unreasonable. The applicant had fulfilled all prescribed criteria under the applicable standing orders and was entitled to consideration and grant of out-of-turn promotion against available vacancies in the year 2022 itself. The respondents failed to honor their own policy and promise, thereby attracting the doctrine of promissory estoppel and legitimate expectation.

It is further submitted that the purpose of Rule 19(ii) of the Delhi Police (Promotion and Confirmation) Rules, 1980 is to encourage exceptional devotion to duty, and the applicant's performance clearly falls within its ambit. However, the respondents adopted a subjective and inconsistent approach by giving undue preference to candidates who performed single acts of gallantry, while ignoring the applicant's sustained and exceptional contribution in recovering a large number of missing children. This departure from long-standing practice, where recovery of missing persons was given priority, is arbitrary and unjustified.
8. The counsel argues that the respondents acted mala fide by favoring certain candidates, particularly those posted in specialized units, thereby engaging in a colorable exercise of power. The failure to conduct the Incentive Committee meeting for 2022 and subsequent merging of vacancies has caused grave prejudice to the applicant.
9. It is also submitted that as per information obtained under the RTI Act, sufficient vacancies existed in both years, and separate consideration ought to have been undertaken. The respondents' failure to do so violates established legal principles laid down by the Hon'ble Supreme Court and the Hon'ble Delhi High Court, requiring fairness, transparency, and adherence to prescribed procedures.
10. In view of the above facts and submissions, the applicant contends that the impugned action of the respondents is illegal, arbitrary, discriminatory, and liable to be set aside, and that he is entitled to be granted out-of-turn promotion from the due date along with all consequential benefits.
11. Learned counsel for the respondents submits that the present Original Application is devoid of merit and is liable to be dismissed. It is submitted that a citation was received at police headquarters from DCP/metro vide diary no. 6122/co-ord. br.-ii/PHQ dated 21.10.2022 for considering the case of HC (exe.) 12. It is further submitted that the provisions of the standing order only confer a right of consideration and not a right of promotion. Accordingly, the case of the applicant was duly considered by the Incentive Committee in its meeting held from 09.11.2023 to 11.11.2023; however, the applicant could not be included in the list of recommended candidates on the basis of comparative merit. it is submitted that there is no obligation on the department to grant out of turn promotion to every eligible candidate and the same depends upon relative merit and availability of limited vacancies under the 5% quota. It is also submitted that the applicant never submitted any representation to the competent authority for review of his case and directly approached the CAT by filing OA No. 564/2024, which itself renders the application premature. It is further submitted that as per the law laid down by the Hon'ble High court of Delhi in Commissioner of Police & Ors. vs. SI Satbir Singh, out of turn promotion is a special incentive and cannot be equated with a statutory right, nor can it be claimed as a matter of entitlement. It is reiterated that the incentive committee, duly constituted vide order dated 18.10.2021, examined all citations received from various districts and units up to 08.11.2023 and considered each case on its own merits in a fair, just and equitable manner.

It is further submitted that the allegations of arbitrariness and violation of Articles 14 and 16 of the Constitution are wholly unfounded, as the applicant's case was duly considered along with other candidates and rejected based on comparative evaluation. it is also submitted that there is no provision requiring priority to be given to cases involving recovery of missing persons over other acts such as gallantry. The respondents submit that due to the large number of citations received each year and the limited quota available, it is not feasible to grant out of turn promotion to all applicants.

In view of the above submissions, it is prayed that the present original application be dismissed as being devoid of merits.
16. After hearing the learned counsel for the parties and upon careful perusal of the pleadings and material placed on record, we find that the controversy involved in the present Original Application is no longer res integra.
17. It is observed that the principal issue arising for consideration in the present case, namely non-convening of the Incentive Committee for the year 2022, clubbing of vacancies/recommendations of the years 2022 and 2023, and denial of consideration for Out of Turn Promotion (OTP) against the vacancy year 2022, has already been examined in detail by this Tribunal in OA No. 3765/2023 and batch (Vinod Kumar & Ors. v. GNCT of Delhi & Ors.), decided on 18.11.2025.
18. In the said decision, the Tribunal, after an elaborate analysis of Rule 19(ii) of the Delhi Police (Promotion & Confirmation) Rules, 1980 and the relevant Standing Orders, has categorically held that OTP vacancies are required to be considered on a year-wise basis and cannot be clubbed across different years. It has further been held that failure to convene the Incentive Committee for a particular year, despite availability of vacancies, and subsequent clubbing of cases of multiple years results in enlargement of the zone of consideration, thereby causing serious prejudice to eligible candidates. 19. The Tribunal in the aforesaid case further rejected the justification of administrative exigencies for not holding the Incentive Committee Meeting in the relevant year and observed that non- exercise of statutory power in such circumstances amounts to arbitrariness. It was also held that diversion of OTP vacancies to regular promotions defeats the very object of the Rule, which is to incentivize exceptional performance.
20. It is further observed that even though Out-of-Turn Promotion (OTP) falls within the limited 5% quota envisaged under Rule 19(ii) for a particular year, the general principles governing Departmental Promotion Committees (DPC), including adherence to the prescribed modal calendar, preparation of year-wise panels, and timely consideration of eligible candidates, are equally applicable. The administrative authorities are under an obligation to ensure that promotion exercises are conducted in a structured and time-bound manner. In the event that, due to administrative exigencies, the Incentive Committee/DPC could not be convened in the relevant year i.e., 2022, it was incumbent upon the respondents to convene the same at the earliest possible opportunity in the succeeding year, as a minimum procedural requirement, while maintaining strict year-wise segregation of vacancies and eligible candidates. The respondents ought to have prepared a separate year-wise panel for OTP promotions for 2022, drawing guidance from the settled principles applicable to regular DPC proceedings. Therefore, the respondents are directed to adhere to these principles scrupulously in all future OTP exercises.

Applying the ratio laid down in the aforesaid judgment to the facts of the present case, it is evident that the respondents did not convene the Incentive Committee for the year 2022 and instead considered the cases of 2022 and 2023 together in the meeting held in November, 2023. Such action is squarely covered by the findings of the Tribunal in the aforementioned decision and cannot be sustained in law.
22. In view of the settled position, we are of the considered opinion that the issues involved in all the OAs are fully covered by the decision of this Tribunal in OA No. 3765/2023 and batch. Accordingly, all the aforesaid OAs are disposed of in terms of the directions issued therein.
23. Consequently, the respondents are directed to consider the case of the applicant for Out of Turn Promotion against the vacancy year 2022 by convening a Review Incentive Committee within a reasonable period. In the event the applicant is found fit, he shall be entitled to all consequential benefits in accordance with law, as already indicated in the aforesaid judgment.
24. All the Original Applications stand disposed of in the above terms.
