2.    We heard both the parties.



3. Referring to the general market crash which took place in January 2008  and more particularly on 22 January 2008, the Appellant had wanted the copy  CIC/SM/A/2013/000172 of the enquiry report in the matter. The CPIO had informed him that the desired  information was not available. Not satisfied, he had preferred an appeal. The  Appellate Authority had disposed of the appeal by endorsing the response of  the CPIO.

During   the   hearing,   the   Appellant   submitted   that   there   was   a   very  serious crisis in the market in January 2008 and that the Joint Parliamentary  Committee   and   many   other   agencies   had   reportedly   probed   into   the   said  market   crash   and,   therefore,   he   was  not   convinced   that   the   SEBI   had   not  looked into this matter. Therefore, he argued that he should be provided with a  copy of the enquiry report. On the  other hand, the respondent categorically  stated that the SEBI had not conducted any enquiry or investigation into this  particular event and, therefore, there was no such report to be provided to the  Appellant.

We  have  carefully considered  the facts  of the  case. If  the SEBI  had  conducted   no   enquiry   into   this   matter   and   if   it   does   not   have   any   such  information in its possession, the CPIO cannot obviously invent  one  for the  benefit of the Appellant. There is simply no information to be given.

6. Therefore, we see no reason to interfere in the order of the Appellate  Authority. The appeal is disposed off accordingly. 

7. Copies of this order be given free of cost to the parties.
