sdas rejected C.R.M. 10307 of 2018 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure filed on 11.10.2018 in connection with Tehatta Police Station Case No. 288 of 2018 dated 31.08.2018 under Sections 376AB/376(2)(i) of the Indian Penal Code and Section 6 of the POCSO Act.
And In Re : Manoranjan Das ..... petitioner Mr. Amit Singh ... for the petitioner Ms. Zarin N. Khan, Ms. Trina Mitra ... for the State Learned Counsel appearing for the petitioner submits that he is in custody for 83 days and it is also submitted that he has been falsely implicated in the instant case. It is further submitted that the medical report does not corroborate the allegations made by the victim.
Learned Counsel appearing for the State opposes the payer for bail and submits that victim was a minor girl.
Having considered the materials in the case diary including the statement of the victim recorded under Section 164 of the Code of Criminal Procedure and keeping in mind the gravity of the offence and prima facie involvement of the petitioner therein, we are not inclined to grant bail to the petitioner at this stage.

And In Re : Rabish Kumar Upadhyay ..... petitioner Mr. Asraf Ali ... for the petitioner Mr. Debojyoti Deb ... for the State Having considered the materials on record prima facie disclosing involvement of the petitioner in the alleged crime of misappropriation of monies of the innocent depositors and the fact that the petitioner has absconded for a protracted period of time, we are not inclined to grant bail to the petitioner at this stage.
