Heard learned counsels for the petitioner, the State and the informant.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 409, 120B, 467, 468 and 420 of the Indian Penal Code.

It is alleged by a retired Junior Engineer that the petitioner as Executive Engineer of the Water Resources Department has worked in the District Board and misappropriated the amount of 16 projects.

It is submitted by learned counsel for the petitioner that since the informant was occupying the quarter after retirement for which the petitioner being the Executive Engineer transmitted letter to vacate the quarter, hence, the present accusation has been levelled when the petitioner worked as Engineer in the District Patna High Court Cr.Misc. No.45085 of 2012 (3) dt.28-01-2013 Board on the direction of the higher authorities.

Considering the accusation levelled by a retired Junior Engineer when the employer has no grievance against the petitioner, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Buxar (T) P.S. Case No. 139 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
