3. The present petition raises grievance with the observations made in the impugned order dated 30.03.2026 passed by the Presiding Officer, Labour Court - III, Rouse Avenue Courts, in LCA 194/25. The said order, inter-alia directs the Municipal Corporation of Delhi (MCD) to pay the outstanding dues to the extent of Rs.2,28,286/- to the concerned applicant. The application under Section 33C(2) of the Industrial Disputes Act, 1947 was, accordingly, disposed of. The petitioner is not aggrieved with the said direction; however, the grievance is with the subsequent observations made by the Court, which are as follows:
"In view of the same, the present application under Section 33C(2) of This is a digitally signed order.

The Order is downloaded from the DHC Server on 02/04/2026 at 22:04:26 Industrial Disputes Act, 1947 is disposed off directing the MCD to pay the admitted dues to the extent of Rs. 2,28,286/- (Rupees Two Lacs Twenty Eight Thousand Two Hundred Eighty Six Only) to the Applicant Sh. Sompal S/o Sh. Bishmber as per rules, within 15 days from today.
Before passing with the order, the Court would like to note the conduct of the Commissioner MCD who has failed to respond to the observations made by this Court in its order dated 14.03.2026 and has failed to ensure filing of proper status reports of action taken by him, if any, pursuant to the directions of this Court in various orders passed by this Court on a daily basis. Under the aforesaid circumstances, I deem it appropriate to send a copy of this order alongwith copy of orders dated 20.02.2026 and 14.03.2026 passed in this case to Home Secretary, Govt. of India for his information with a hope that he will ensure furnishing of proper reports by Commissioner MCD in compliance of orders of this Court in future. Let the copies of the aforesaid orders be accordingly sent to Home Secretary, Govt. of India today itself through all modes including through email.
At this stage, it is submitted by Ld. AR for Managements that the Commissioner MCD has all the respect for the orders passed by this Court and is taking all possible steps for the timely compliance of the orders of this Court.
Be that as it may, the Court is expecting from the Commissioner MCD to apprise this Court in writing about the alleged steps taken by him for timely compliance of orders of this Court, however, the Commissioner MCD is finding it difficult, for reasons best known to him, to furnish the reports in this regard to this Court despite repeated directions.
File be consigned to record room after due compliance. Copy of this order be given dasti to both the parties. At this stage, it is submitted by AR of Managements that the Commissioner MCD shall furnish a proper status report about steps/ action taken by him to ensure timely compliance of orders of this Court within two days from today."

At the outset, learned senior counsel for the petitioner expresses regret at the miscommunication and the lapse/s on the part of the MCD in the concerned proceedings which impelled the Court to make the aforesaid observations. He assures that requisite steps have been taken to allay the concern/s of the Court, which led to the aforesaid observations. However, it This is a digitally signed order.

The Order is downloaded from the DHC Server on 02/04/2026 at 22:04:26 is submitted that the observations in the judgment are gravely prejudicial to the petitioner and the Commissioner, MCD.

Considering the circumstances, the petition is disposed of with liberty to the petitioner to move an appropriate application before the concerned Court for expunction of the aforesaid remarks, in light of the circumstances sought to be emphasized by the petitioner and considering that steps are stated to have been taken to allay the concern/s expressed by the Court. The details thereof shall be placed on record before the concerned Court.
6. Learned senior counsel for the petitioner states that an appropriate application for the aforesaid purpose shall be moved by the petitioner within a period of two weeks from today. Let the same be done within the said period.
7. The impugned observations / directions shall not be given effect to till the said application is filed and duly considered by the concerned Court (POLC-III/Rouse Avenue Courts).
8. The petition is disposed of in the above terms.
