                 CRIMINAL PETITION No.2475 of 2020

O R D E R:

The present criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in Crime / FIR.No.318/2020, dated 02.06.2020, on the file of Medipally Police Station, Rachakonda Commissionerate, Cyberabad, registered against the petitioners / arrayed as accused Nos.1 to 3, for the offences punishable under Sections 420, 406, 465, 468 and 471 read with Section 34 IPC.

2. The present criminal petition is taken up for hearing today, i.e. 15.06.2020, through Video Conferencing.

3. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

4. Though learned counsel for the petitioners filed the present criminal petition for quashing the proceedings in the above crime, he restricts his prayer to the limited extent of seeking a direction to the investigating authorities to follow the procedure prescribed under Section 41-A Cr.P.C. and the guidelines set out by the Hon'ble Apex Court in the case of ARNESH KUMAR V/s. STATE OF BIHAR1.

5. Learned Additional Public Prosecutor submits that the respondent police authorities would follow the guidelines prescribed by the Hon'ble Apex Court in ARNESH KUMAR's case (supra).

6. Having regard to the submissions made as above, the respondent police authorities / investigating agency are directed to follow the 1 (2014) 8 SCC 273 2 procedure prescribed under Section 41-A Cr.P.C. and abide by the guidelines as set out by the Hon'ble Apex Court in ARNESH KUMAR's case (supra).

7. Subject to the above, the Criminal Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed.
