This application is made for restoration of consumer complaint no.53/1999 which stood dismissed for default. In view of the decision of the apex court in the matter of Civil Appeal no.4307/2007 with Civil Appeal no.8155 of 2001 decided on 19/08/2011, Rajeev Hitendra Pathak & others v/s. Achyut Kashinath Karekar & another, (Quorum Honble Dalveer Bhandari, Honble Mukundakam Sharma, Honble Anil R.Dave, JJJ), the issue is well settled. This Commission has no power for restoration and, consequently, the application cannot be entertained. Holding accordingly, the same stands dismissed.
No order as to costs.
