Heard learned counsel for petitioner as well as learned Public Prosecutor and perused material made available to me during course of arguments.
Contention of learned counsel for petitioner is that he was arrested in the present case and subsequently three more cases were registered against him. Recovery of motorcycle that was already seized from the petitioner, was shown to have been made at the instance of the petitioner. Petitioner is in jail since 07.01.2012. Trial may take a long. Petitioner is ready to face the trial. Petitioner would undertake not to indulge in any offence in future and would maintain good conduct. There is no chance of fleeing the petitioner from justice.
Learned Public Prosecutor opposed the bail application.
After considering all the facts and circumstances of the case and without expressing any opinion on its merits, I deem it just and proper to allow this bail application. It is therefore ordered that accused-petitioner, namely, Rajkumar @ Raju S/o Shri Shivlal, R/o Village Phahari, Police Station Govindgarh, District Alwar (presently confined in District Jail, Alwar) be released on bail under Section 439 Cr.P.C., in FIR No.514/2011, Police Station Shivaji Park, Alwar, under Section 379 IPC, provided he furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the trial court for his appearance on all subsequent dates of hearing and as and when called upon to do so.
However, petitioner shall report to the concerned Police Station on 1st and 15th day of every month and that in case he is again found indulging in any other offence or induce, intimidate or threat to any witness or temper with any evidence, or if any other criminal case is found to have been registered against him, except mentioned above, either previously or hereafter, the bail granted to him in this matter as well as in previous matters also, shall be cancelled by the trial court at the instance of the prosecution.
The bail application stands disposed of.
