Both these Original Appiications are being disposed of by a = common order, treating OA No IST/2021 as lead, as the issues involved in both these applications are same.

OA No él2d2t has been fled by eighty-three applicants who were in position or promoted an the past of Senior Chargemen at the relevant time, ie. in the vear JOS6, and are claiming their pay fixation In the pay-sesle af Rs.5S00-90004 wef OLGL 1986. The GA has been Bled se eking benefit of the judgement passed by the coordinate bench of the Tribunal at Ernakulam in GA No. I8G/O0254/261S dated (7% Jan, 2019 and ago March, 2019. The topiteante- submit that they are © entically and similarly placed as the applicants in both the above mentioned Stiginal Applications, and are seeking the same benefits. [t has been Ruther stated that both these judaments --_ by two different benches of the Tribunal are primarily based on the judgment of the Hon'ble High Cowt of Kerala in OP (CAT) No.2? i of 2016 (2) dated 20" July, 2017. Therefire they submit that the present OA has been filed against the inaction of the respondents in not granting the said pay-seale tw all similarly 4y situated, which can be road-as re stricting ths grant of said pay- scale and consequent pay-fixation to the appNcants, meanwhile granting the same only to those persons approaching the court. It is thus submitted that it is this inaction on the part of the respondents which has foreed the applicants to file the nresent OA.

The stand now taken before this Court from the fart of the respondents is that, a different 'work st uddy" was conducted and it was accordingly, that Werent pay scales were provided Wefind tr "ifficult to accept the said proposition in Viewatthelindins on factarrived at by the Directorate ag disclosed from Annexure. Ali. This being the position, itisnat open forthe respondents to take a 'U-turn' to say something else now, contrary ta the contents of Armexure A-1]1 1Q. Ttis also brought to the notice eo! ef this Court by the learned counsel for the petitioners chet though the matier was caused ta be cxamined by the 6th CPC and also the. 7th CPC, they didnotgo inte these aspects, particularlywith reference to the contents af Annexure Alland henoethe "disparity continues, It isalso stated that, pursuant te the implementation afthe recommendations ofthe 6th CPC, persons. who belong to different classes/categories have been | rough io a caramen pos! with a comman pay scale; but by virtue of the disparity alredy resulted, because of the wrong exercisedane by the re spoudents, the gap between the petitioners Gu NSR) and their counterparts gn NASO) has been widened like anyth hing, which requires immediate rectification at the hands of this Court.
li. After hearing both sides, we find that Ext.P3 order passed by the Tribunal declining imterference with Annexure A-10 is not correct or sustainable and they are Hable to be intercepted.

4. Counsel for the applicants pointed out to the letter dated 16" Oet, 2018, which is the order of implementation of the order passed by the Hon'ble High Court of Kerala, issued by the respondents, which reads thas:

5. Per contra, the respondents have fled their counter afiidavit and have contested the claim of the applicants on varions grounds. Drportanily, being that anplicants are fence sitters and they have approached the tribunal belatedly only afler others get relief from the courts and therefore do not deserve any relief. Respondents have relied upon the following judgments primarily an the ground that the padements passed by the Tribunal in the aforesaid two OAs are judgments i personam and therelore applicant cannot claim any relief based on them

(i) Judgment of the Hor'ble Supreme Court in the ease of Ramesh Chand Sharma vs. Udham Singh Kamal &Ors., (1999) 8 SOC 304,
(iv) Judgment of the Hon'ble Supreme Court in the case of State of Maharashtra &Ors. va. Anita &Ors., (2016) 2 SCC CLES) 384, iv} Judgment of the Hon'ble Supreme Court in the case of State of Madhya Pradesh vs. Pramod Bhartiya &Ors., (1993) 18 SOC Thus, they state that once the jJudements are in Personam, ihe respondents cannot be faulted for not having extended the same benefits to the applicants. Moresa, the present petitions are barred by delay and laches,
6. We have heard the arguments of both parties at length and perused the materials placed on record. ?, Hon'ble Supreme Court in the case of State of Utter Pradesh &Ors. ys. Arvind Kumar Shrivastavea@Orsin Civil Appeal No.9849 of 2014 arising out of SLP (C) No.18639 of 2012 had categorically held that normal rule is that when a particular set af employees is given relief by the Court, all ather identically Situated persons need to be treated alike by extending that benefit and not doing so would amonnt to discrimination and viclation of Article 14 of the Constitution of India, However, this principle is subject to well recognized exceptions in the form of laches and delays as well as acquiescence. Those persons who did not LEE LOOT OA Nos, IRLQO2 |) and Lasers challenge the wrongful action. in their cases and acquiesced into the same and woke up after long delay only because of the reason that thetr ca interparts + who had approached the Court carlier in time sreceeded in their efforts, then such employees cannat claim that the benefit of the judgment rendered in the case of similarly situated persons be extended to therm. But this exception may not apply in those cases where the judement pronounced by the Court was judginent in rene with intention to give benefit to all similarly siinated persons.
8. Befere we delve into the controversy further, it would be relevant to point out to para 9 of the counter affidavit filed by the respondents which reads as under:

However, decision of the Competent Authority is awaited", 2, From the above, if can be seen that this issue is being eliberated upon by the competent authority and the present respondents have as late as on 22.03.2021 processed the case of OA Nas. INN S02 bcand £15023 tie applicants also. Further they have forwarded the details/data as sought by the headquarters in that regard. As the issue is alive and kicking and beiig-considered at the competent pone syel, we need not go info the controversy argued above. Rather we can say that the x £ OA fled by the applicants is not hit by delay as final decision has not been taken. Even otherwise the issue is of grant of proper pay St eal, Hon'ble Apex Cont in MLR. Gupta vs Union Of India, 1996 AIR G69, 1995 SCC (5} 628 has held as ander:
"The Tribunal misdirected itself when it treated the appellant's claim as 'one time action' meaning thereh eby that it was not a continuing wrong based on a x ecuiring cause af action. The claim to be paid the correc i salery computed on the basis of proper pay fixation, is a right which subsists during the entire tenure of service and can be exercised at the lime af each payment of the salary when the employes is enuitled to salary computed correctly j in accordance with the miles. This right of a Government servant to be paid the correct salary throughont his tenure according to computation made im accordance with rules, is akin to the | right of redemption which is an incident of a subsisting | mortgage and subsists so long as the mortgage iiself subsists, unless the equity of redemption is extinguished, it is settled that the right of redemption is of this kind, (See Thota China Subba Ran and Others vs. Mattapall: Raju wand Others, ATR 1950 Federal Court 1}, For the aforesaid reasons, this appeal has to be allowed, We make it clear that the merits of the appellant's claim have to be examined and the only point concluded by this devision is the one decided above, The question of limitation with regard to the consequential and other reliefs OA Nos. ISE202] and LiSo023 inclading the arrears, if any, has to be considered and decided in accordance with law in due course by the Tribunal. unplementation of the said judement im. the cass of the present applicants by their own letter of 22.02.2021, as is apparent from pars 9 of their counter affidavit, no final decision bas been taken as yet. Therefore, it cannot be said to be barred by delay, however, aS We are In agreement with the order passed by this bench earlier following the same, we direct respondents to consider grant , pay-seale of Rs.5300-9000/- in place of Rs.SO00-8000/ to the applicants im the present Original Applications, as has been granted to the applicants in MLRS.
