1. The instant application being CAN No. 4028 of 2017 has been preferred
by the applicants seeking, inter alia, directions in the nature
of mandatory orders for restitution of possession of certain immovable
properties from which the said applicants were allegedly dispossessed,
forcibly and without authority of law, at the instance of the One-Man
Committee (hereinafter referred to as 'the Committee') constituted
pursuant to the orders of this Hon'ble Court dated 23rd December, 2015
in MAT Nos. 559 and 512 of 2015.
2. The applicants are admittedly not parties either to the writ petition being
WPA No. 4059 (W) of 2015 (Bhaskar Dasgupta & Ors. v. Union of India &
Ors.) or to the associated appeals preferred therefrom. The original writ
proceedings related to regulatory actions against certain MPS Group of
Companies, including the Appellant Company herein, for alleged

misappropriation and unlawful collection of public deposits. Pursuant
thereto, the Hon'ble Division Bench of this Court had constituted the
Committee under the chairmanship of Hon'ble Mr. Justice S.P. Talukdar
(Retd.) for the purpose of identifying, securing and disposing the assets
of the company so as to effect repayment to the legitimate depositors.
3. The applicants claim rightful and lawful ownership of ten immovable
properties situated in and around Kolkata, jointly owned by them along
with one Mr. Pramatha Nath Manna, who was a Director of the Appellant
Company. The said properties were acquired over a period of time prior
to the institution of the writ petition and the subsequent constitution of
the Committee. It is specifically stated that these properties are either
used directly by the applicants for residence and/or business or
tenanted by third parties under valid agreements.
4. By a detailed representation dated 15th November, 2016, the applicants
had proactively brought to the notice of the Committee the factum of
joint ownership of the said properties. The said notice was supported by
documentary evidence including certified copies of title deeds, valuation
reports, municipal tax bills and utility connections in joint names. The
letter also contained a tabulated list of those joint properties with dates
of purchase and occupancy details.
5. The applicants allege that notwithstanding such notice, there has been
no adjudication whatsoever by the Committee acknowledging or denying
the joint ownership. It is further submitted that despite there being no
finding of misfeasance, fraud or unlawful enrichment attributable to the
applicants, the Committee, by engaging the services of one Mr. Nakul
Chandra Chaki, along with police assistance, forcibly entered and affixed
locks upon the said premises commencing on 20th April, 2017.
6. It is the categorical assertion of the applicants that around 3:45 p.m. on
20th April, 2017, the aforementioned officer of the Committee, assisted by
personnel from Lake Town and Bidhannagar Police Stations, entered into

one property after another, threatened occupants, forcibly evicted
tenants and padlocked the premises, thereby taking khas (physical)
possession of said properties. No seizure list, inventory or reasoned order
underpinning such action was produced, despite repeated requests made
on spot.
7. The applicants further state that upon being questioned, one Mr. Chaki
allegedly refused to exhibit any order authorizing such seizure. When
telephonic queries were raised with the Nodal Officer of the Committee, it
was conveyed that no show cause or prior notice was necessary if the
properties belong to or are associated with the Director of the Appellant
Company. This assertion, however, ignores the legal distinction between
joint and exclusive property and violated the applicants' rights under
Articles 14 and 300A of the Constitution of India.
8. On the said date, i.e., 20thApril, 2017, upon mention made in open Court
before the Hon'ble Division Bench presided over by Justice Aniruddha
Bose and Justice Joymalya Bagchi, it was orally clarified that no specific
orders had been passed authorizing the Committee to take khas
possession of the properties jointly owned by non-parties without
adjudication of title.
9. It has been further submitted that the scheme of the order dated
23rdDecember, 2015, which governs the functioning of the Committee,
contemplates administrative and quasi-judicial functions for identifying,
verifying and disposing assets belonging to the Appellant Group of
Companies and/or their Directors, for the sole purpose of satisfying dues
owed to bona fide depositors. There is no express authority conferred
therein to unilaterally determine or assume ownership of third-party or
jointly held private properties without due process of law.
10. The applicants have expressly stated that they were never
Directors of the Appellant Company during the relevant period, that they
have retired from other group companies long before the institution of

these proceedings in 2015 and that no order issued by SEBI, CBI, ED or
this Hon'ble Court has been passed against them personally nor against
any third-party properties alleged to be held jointly. Further, no material
has been placed on record by any authority to establish that the
applicants were beneficiaries of any illegal collection of public funds or
that the said properties were acquired from such proceeds.
11. It is further contended that the sudden and unheralded sealing of
residential premises has caused immense hardship, particularly to the
senior female members and minor dependents of the family. The
dispossession, effected without judicial imprimatur, has rendered the
applicants vulnerable and displaced, despite possessory and ownership
rights which till date remain uncontroverted.
12. In light of the above facts and submissions, the applicants seek
orders for restoration of khas possession of the properties, a prohibition
upon further coercive steps by the Committee and a direction upon the
Committee to adjudicate the question of ownership before taking over
any such properties, by affording the applicants an opportunity of
hearing.
13. Similarly, CAN 48 of 2024, has been moved by the
appellants/applicants in the pending appeal being MAT No. 559 of 2015
seeking various directions upon the Committee appointed by an order
passed by this Hon'ble Court dated 23rd December, 2015.
14. The present appeal being MAT No.559 of 2015 arises from an order
dated 30th March, 2015 passed in WP No. 4059(W) of 2015, wherein the
respondent nos. 1 to 7, as writ petitioners, sought reliefs under Article
226 of the Constitution of India. During the pendency of the appeal, by order dated 23rd December, 2015, this Court was pleased to appoint a One Man Committee to, inter alia, identify and secure all records and properties of the appellant group of companies, ascertain the names and particulars of depositors (other than agents), dispose of assets by public Page 5 of 32 auction and formulate a scheme for disbursement to depositors (other than agents) upon approval by this Court.
15. It is submitted by the learned counsel for the appellants/applicants in the present CAN application 48 of 2024 that, despite repeated directions from this Court, the Committee has failed to:
a. Provide the appellants/applicants with copies of essential documents and inventory reports, including but not limited to cash books, ledgers, journals, balance sheets, board resolutions, agents' details, shareholder registers, AGM/EGM notices and minutes, asset registers, building sanction plans, licenses, SEBI and ROC correspondence, tax documents, employee details, vouchers, invoices, bank statements, loan details and property details relating to MPS Greenery Developers Limited and its group companies, as well as family business records of certain individuals associated with the company;
b. Secure and protect all movable and immovable properties of the appellants/applicants' company, including those seized by investigating agencies and to take effective steps to remove illegal encroachments and unauthorized occupation of such properties; c. Segregate agents from the list of investors and to publish an accurate, exhaustive list of genuine investors (other than agents) on the Committee's official website as one of the agents has already collected more than twenty lakhs form the committee depriving the poor depositors;
d. Fix a cut-off date for submission of claims by investors (other than agents) and to ascertain and publish the total liability due to such investors, as per the mandate of the order dated 23rd December, 2015;
Page 6 of 32 e. Consider and dispose of various applications and representations filed by the appellants/applicants before the Committee, including the application dated 8th April, 2024, which remain pending without adjudication.
16. It is further submitted by the counsel that although a list of 18,226 investors was communicated to the petitioner herein, the said list is admittedly not exhaustive and includes a substantial number of agents, contrary to the directions of this Court. The appellants/applicants claims that approximately 30% of the names in the said list are agents and that the Committee has not taken adequate steps to segregate agents from investors, thereby frustrating the object of the order dated 23rd December, 2015.
17. The appellants/applicants also submit that, despite the lapse of nearly a decade since the appointment of the Committee, the process of ascertaining the liability to investors (other than agents) remains incomplete, only a paltry sum of Rs. 10,000/- has been disbursed to certain investors without proper verification against the company's records. Furthermore, the total amount due to investors (other than agents) has not been published and the process for submission of claims remains open-ended, causing uncertainty and prejudice to all stakeholders.
18. It is also brought to the notice of the Court that the appellants/applicants have repeatedly requested the Committee to take immediate legal steps to remove unauthorized encroachments such as gumtis, shops, stalls and dumping of garbage, from the properties under the Committee's custody, as such encroachments are causing damage and depreciation to the value of the assets, to the detriment of the investors and stakeholders.
19. The appellants/applicants have, accordingly, prayed for immediate supply of all relevant documents and inventory reports as detailed in the Page 7 of 32 application; effective steps to secure and protect all movable and immovable assets, including removal of illegal encroachments with the assistance of local authorities; segregation of agents from investors, publication of an exhaustive list of eligible investors and fixation of a cut- off date for submission of claims; ascertainment and publication of the total liability due to investors (other than agents) in terms of the order dated 23rd December, 2015; consideration and disposal of all pending applications and representations filed by the appellants/applicants before the Committee.
20. Learned Counsel appearing for the One-Man Committee in compliance with the directions issued by this Hon'ble Court, has duly submitted a comprehensive report pertaining to the functioning of the One-Man Committee chaired by Hon'ble Mr. Justice S.P. Talukder (Retd.). The said report, duly submitted by the Joint Secretary, is annexed hereto:
"Comprehensive Report regarding functioning of Hon'ble Justice S.P Talukdar One Man Committee Originally Hon'ble Justice S.P Talukdar One Man Committee was constituted by the solemn order of the Hon'ble Division Bench presided over by the then the Hon'ble the Chief Justice on 23.12.2015 passed in MAT 559 of 2015 appointing Hon'ble Justice S.P Talukdar (Retired) as the Chairman of the said One Man Committee to deal with the properties and assets of only MPS Group of Companies and its investors/depositors with the following directives:
"(i) To identify, make inventory and secure all the records of the appellant group of companies and its directors in respect of movable, immovable properties including those seized by the police including like the original sale deeds and other document like fixed deposit receipts, etc. belonging to the above MPS Group of Companies with Page 8 of 32 the assistance of machinery of the State and the Central namely State police, CBI and SEBI etc..
(ii) To ascertain the name and other particulars of depositors (other than agents) and to verify their applications to ascertain the exact amount of deposit invested by them.
(iii) To dispose of all the assets movable and immovable belonging to the MPS Group of Companies and its directors by public auction.
(iv) If moneys are payable to the MPS Group of Companies, recover the same and to credit to the corpus fund to be created for the purpose of the scheme by attaching movable and immovable properties, Bank accounts etc..
(v) After completing the process of sale and identifying the names of the investors and the amounts due to them, the committee will formulate a scheme which has to be placed before the Court for approval.
(vi) Upon such approval the committee shall disburse the amounts to the depositors (other than agents) after due identification in terms of sanctioned scheme.
The Committee is permitted to open Bank account in any nationalized bank for the purpose of depositing the corpus fund to be operated by the persons authorized by the Committee." Pursuant to the above, Hon'ble Justice S.P Talukdar (Retd.) assumed charge of this One-Man Committee as the Chairman with effect from 01.02.2016. Thereafter, in terms of order passed by the Hon'ble Division Bench on 31.08.2016, Sri Subrata Mitra (Retired District Judge), was directed to be appointed as the Nodal Officer to assist the Committee in the matter of complying with the said directions of the Hon'ble Court contained in order dated 23.12.2015. A copy of the said order is enclosed herewith and marked with letter 'C' for kind perusal and consideration. Page 9 of 32 Sri Mitra, accordingly, assumed charge of the post of Nodal Officer of the Committee with effect from 29.11.2016 while Mr. Neguive Ahmed was also appointed as the Advocate for the Committee. The Committee, accordingly, started functioning.
Subsequent to the above, requisitions were made to the State of West Bengal from time to time to provide necessary logistic support including the required personnel of different posts for proper and smooth functioning of this Committee. Copies of such communication are enclosed herewith and marked with letter 'C/1' collectively for kind perusal and ready reference. However, despite issuance of such requisitions and for reasons not made explicit to this Committee, there was inordinate delay on the part of the State of West Bengal to provide required logistic support and human resource.
Ultimately, with the intervention of NIC and subsequently of Webel Technology Ltd., it was possible to make the Website and Web portal of this Committee functional since the year 2019.
However, due to Pandemic on account of spreading of Covid-19 virus, this Committee could not function in the year 2020 though it became partially functional in the year 2021.
Despite lack of necessary support from the State, this Committee started functioning with minimum and limited resources to comply with the direction of the Hon'ble Court as given in the said solemn parent order dated 23.12.2015 in MAT 559 of 2015.
In the meantime, and even thereafter, on the basis of diverse orders passed by the Hon'ble Court in several writ petitions, the properties and affairs of many other Chit Fund Companies in addition to those of the MPS Group of Companies were also referred to this Committee in similar manner as directed by the said solemn order dated 23.12.2015 (supra). Copies of some relevant orders passed by the Hon'ble Court from time to Page 10 of 32 time regarding such entrustment are marked with letter 'C/2' collectively and enclosed herewith for kind perusal and ready reference of the Hon'ble Court.
It is most unfortunate to iterate in this context that though the volume of work of this Committee increased to a great extent for dealing with the properties/assets and payment of investors in connection with the said Chit Fund Companies in addition to the MPS Group of Companies, yet there was hardly any prompt response from the side of the State to proportionately provide additional logistic support and man-power to this Committee which deficiency practically affected the flow and speed of work of this Committee adversely.
It may not be out of place to mention in this context that as the volume of work cumulatively started increasing, several representations were made before the State for providing additional logistic support and human resource but without any fruitful result, thereby compelling the Committee to ultimately move the Hon'ble Court when, by orders dated 13.02.2025 and 20.02.2025 the Hon'ble Court was pleased to issue time bound direction upon the State and its principal Officers to provide such logistic support and human resource in consultation with the Committee. Only after issuance of such orders by the Hon'ble Court, the State proceeded to address the requirements of the Committee considerably but refusing to provide any full time Accounts Officer till now. The additional logistic support as required by the Committee has not also been completely provided by the State as yet.
In this connection it is worthy to mention that Government order relating to engagement of retired officers/staff to this Committee on re-employment basis till they attain the age of 65 years or till the termination of the Committee or until further orders of the Government, whichever is earlier, was earlier used to be issued at the time of their engagement but, it now appears that the State is trying to do away with the said mode and Page 11 of 32 manner of appointment on re-employment as at present such tenure of officers/staff is being made for a period of only one year/six months or till the completion of tenure of the Committee, whichever is earlier. The State, without any rhyme or reason, has resorted to engage the officers/staff for a meagre period of one year/ six months only without consulting this Committee in the absence of conformity and of trained officers/staff, who have acquired knowledge and experience regarding the work of the Committee.
The Hon'ble Court, by its Order passed on 20.02.2025, was pleased to take the above aspect into consideration and was pleased to observe that the Learned Advocate General had assured the Hon'ble Court that corrective steps would be taken in the matter. However, this Committee is constrained to bring the matter to the notice of the Hon'ble Court again, that till date the State is yet to take any corrective action as assured by the Learned Advocate General.
Copies of the Orders of the Hon'ble Court passed on 13.02.2025 and 20.02.2025 are enclosed herewith and marked with letter 'C/3' collectively for kind perusal and ready reference.
In spite of such obstacles and constraints, this Committee took steps and prepared schemes inviting and receiving applications as well as making disbursement of payments after verification and scrutiny of the applications through online mode with the assistance of Webel Technology Limited. The said schemes were submitted before the Hon'ble Court for approval and after obtaining such approval, the above exercise commenced.
The exercise for inspection/inventorisation of properties of different Chit Fund Companies commenced since the year 2017 while applications from investors/depositors started to be submitted in online mode with the Committee since after the Website became functional since the year 2019. Both the exercises continued simultaneously.
Page 12 of 32 After receiving the online applications from the investors, those are verified and/or scrutinized thoroughly with the assistance of Data Entry Operators, System Administrators) and other Officers in three tiers for making those ready for payment through online mode against the Bank Accounts of the investors/depositors provided in their respective applications.
After conducting enquiry and inventory of the immovable properties of different Chit Fund Companies under the control of this Committee, market values thereof are ascertained from the Office of the Inspector General of Registration and Commissioner of Stamp Revenue, West Bengal as well as the District Registration Offices, where those properties are actually situated.
It is also pertinent to mention that the process of auction was delayed in several instances on account of delay in the matter of obtaining certified copies of the properties as well as market value thereof from the Office of Inspector General of Registration and Commissioner of Stamp Revenue, West Bengal (IGR) and District Registration Offices. Accordingly, this Committee very recently in the month of March, 2025 took up the issue with the Inspector General of Registration and Commissioner of Stamp Revenue, West Bengal for engaging Nodal Officers from both the sides to minimise such delay and to expedite the process of supplying the valuation and the certified copies of the properties referred by the Committee to the Office of the IGR & CSR, W.B and the District Registration Offices. Now this Committee seeks the indulgence of the Hon'ble Court to accord permission for placing a detailed company-wise statement of the properties of 14 numbers of Chit Fund Companies and applications received from the investors/depositors in the form of a Chart marked with letter 'C/4' collectively, which has been prepared after thorough consultation of the committee's files and records for the kind perusal and consideration of the Hon'ble Bench. This Committee at the same time craves leave of the Page 13 of 32 Hon'ble Court to place similar statement in respect of the remaining Chit Fund Companies referred to this Committee from time to time on or before the date of hearing on 10.07.2025 after their thorough cross-consultation and scrutiny of the Committee's records.
It is submitted that the Committee is continuously updating the records/data connected to its functions as enunciated above particularly the inventorisation and valuation of properties of individual chit fund companies, the receipt of applications from investors/depositors in respect of individual chit fund companies, validation, scrutiny/ verification, and approval/confirmation of bona fide investors/depositors, resulting in ultimate disbursement through Online Mode to such individual investors/depositors through the Bank Accounts and maintaining the corpus of funds available against Accounts marked to each Chit Fund Company upon sale of their respective assets with the State Bank of India, Specialised Institutional Banking Branch, Samriddhi Bhawan, Kolkata. The Committee craves leave of the Hon'ble Court to produce the above updated records/data before the Hon'ble Court as and when directed to do so.
It may not be out of place to mention in this context that in the meantime payment to investors/depositors had to be stopped by this Committee since the Month of December, 2024 in view of detection of fraud committed upon this Committee by two accused persons of Hare Street Police State Case No.341 dated 17.12.2024, being GR 1275 of 2024 pending before the Court of Learned Chief Judicial Magistrate, Kolkata, who embezzled money from the corpus fund of MPS Group of Companies dishonestly. Thereafter with the assistance of Webel Technology Limited and experienced I.T Professionals, this Committee has been constrained to frame a revised Standard Operating Procedure (SOP) for making online applications by the investors/depositors and making payment in their favour after fulfilment of required formalities observing stringent Page 14 of 32 procedures and required formalities so that such incident may not recur in future. As the implementation of the said SOP is still awaited due to want of necessary funds from the Government of West Bengal, therefore, for the time being acceptance of online applications has also been stopped. However, at this juncture the Committee is continuing with the exercise of validating, verifying and approving the applications of investors/ depositors as well as making payments submitted prior to the incident of fraud.
The entire report is, accordingly, placed before the Hon'ble Chairman for kind perusal and consideration and for issuing necessary instructions in the matter."
21. The Learned Counsel further submits that the Committee is doing whatever it can within the limited resources and constraints it faces; however, the State is not co-operating with them effectively. Despite repeated requisitions and specific directions from this Hon'ble Court, the necessary logistical and financial support required for the smooth functioning of the Committee has not been made available. Such lack of support continues to impede the ability of the Committee to fulfil the mandate entrusted to it by the Court.
22. However, at this juncture the Committee is continuing with the exercise of validating, verifying and approving the applications of investors/depositors as well as making payments submitted prior to the incident of fraud.
23. It is further submitted by the learned counsel that, as reflected in the annexure to the report, a total of 55 companies has been brought under the purview and supervision of the said One-Man Committee, details whereof are enumerated as follows:

25. Learned Counsel for the State further contends that all requisite and necessary funds, indispensable for the smooth running of the committee shall be disbursed and released at the earliest.
26. The Learned Counsel representing the Enforcement Directorate has filed a report and respectfully submits that, over and above the 115 properties previously attached and seized under the committee's purview, the Enforcement Directorate has undertaken attachment and adjudication of an additional 36 assets. The Learned Counsel further submits that the committee is yet to take custody or control of these said assets. In support of the foregoing submissions, the Counsel places reliance on the order of this Hon'ble Court dated 16th February, 2017, the pertinent portions of which are reproduced hereinbelow:
"In course of hearing today, Mr. Chanda, learned Additional Solicitor General submitted before us that there was request from the Committee for help and assistance from the Enforcement Directorate for effective implementation of different orders of this Court by the Committee.
We are of the view that for implementation of our order help and assistance of a specialised investigation agency is necessary. Let the Enforcement Directorate extend whatever help the Committee needs for the purpose of implementation of different orders passed from time to time by this Court for identification, recovery and other allied matters concerning the assets of the respective companies or incidental thereto."
27. The Learned Counsel representing the depositors submits that the depositors have not been duly apprised or formally notified regarding the disbursement or release of the requisite funds owed to them as per the directives or orders of this Hon'ble Court and prays leave to file an affidvait.
28. Having considered the submissions of learned counsel for the parties, perused the applications and the records and having regard to Page 30 of 32 the directions issued by this Court from time to time, including the order dated 23rd December, 2015, this Court is of the considered view that the grievances raised by the applicants in CAN 48 of 2024 warrant urgent redressal to ensure compliance with the mandate of this Court and to protect the interests of the depositors and all other stakeholders.
29. This Court is therefore, of the view that assistance from a specialised investigative agency is imperative for the effective implementation of its orders. Accordingly, the Enforcement Directorate being respondent no.9A in MAT 559 of 2015 is directed to extend all necessary assistance to the Committee, as and when sought, for the purpose of implementation of the various orders of this Court, particularly with respect to identification, recovery and allied matters concerning the assets of the respective companies or any issue incidental thereto.
30. In furtherance of the objectives underlying the constitution of the Committee and in view of the delay occasioned by the fraudulent acts that earlier impeded proceedings, the Committee is directed to forthwith initiate the process of sale of assets, and distribution of proceeds of sale which had hitherto been stalled. The proceeds thereof shall be preserved for equitable distribution among verified claimants on prorate basis, in accordance with law.
31. The Committee shall also issue public notices through appropriate channels inviting depositors of all 55 companies to upload their deposit certificates and relevant documents. Simultaneously, steps shall be taken to identify agents engaged in mobilisation of funds and restrict payments to the agents at the time of verification of claims.
32. The Committee shall be responsible for inviting and processing such claims from depositors within a period of six months from the date of this order. A progress report shall be submitted before this Court within one month from the initiation of this process, indicating the Page 31 of 32 number of claims received, the nature of preliminary scrutiny undertaken and any bottlenecks identified.
33. The disbursal of amounts, as indicated in the tabulated chart annexed to the Committee's latest report and reflective of verified depositors, shall be undertaken at the earliest. Such disbursal shall be supervised by the Committee, ensuring transparency and compliance with this Court's orders.
34. Further, appropriate steps shall be taken by the Committee, in consultation with the Enforcement Directorate, for taking over the assets presently in the custody or control of the Directorate, in furtherance of earlier directions of this Court and for the expeditious disbursement to the rightful depositors.
35. Let CAN 4028 of 2017 and CAN 48 of 2024 in MAT No.559 of 2015 appear in the list on 1st August, 2025.
36. Learned counsel appearing for the CBI files report. Let the report be kept with the record. It is observed that the said report bears the date 25th September, 2020. Learned counsel is requested to file a fresh report by 1st August, 2025 which should contain all materials and information till date.
Learned counsel for the CBI further submits that the report which has been filed before this Court is circulated to all the concerned parties in this matter.
