IN THE HIGH COURT OF JUDICATURE FOR
               RAJASTHAN AT JODHPUR

                    D.B. S.A.W. No.474/2002

Date of order : 24.2.2010

           HON'BLE MR.JUSTICE A.M.SAPRE

HON'BLE MR.JUSTICE DINESH MAHESHWARI Mr. S.P.Sharma, for the appellant.

<><><> This is an intra court appeal filed by writ petitioner of Writ Petition No. 4221/2000 under Section 18 of the Rajasthan High Court Ordinance against an order dt. 30.1.2002 passed by the learned Single Judge in Writ Petition No. 4221/2000. (2) While disposing of the writ, the learned Single Judge made following observations:-

"On a letter petition notices were issued to the respondent. The respondent has put in appearance. Counsel for the respondent submits that it is a private dispute between the applicant and one Meva Ram Jain. State has nothing to do in the matter. In view of the reply nothing is required to be done. The petition is consigned to records."

(3) Having heard learned counsel for the appellant and on perusal of the record of the case, we find that the appropriate course open to the appellant in this case would be to take appropriate recourse to all legal remedies available to him in law before appropriate forum in respect of grievance for which letter 2 petition was addressed to this Court rather than to persue this appeal. In case, if any such remedy is resorted to by the appellant, for adjudication of his grievance then the same shall be examined on its own merit in accordance with law by a competent legal forum.

It is with these observations and liberty we are inclined to dispose of this appeal.

No cost.
