ORDER
Information sought:
The Appellant filed an RTI Application dated 24.11.2020 seeking information on the following five points:Page 2 of 7
CIC/NITKS/A/2021/610123 The CPIO, National Institute of Technology, Kurukshetra vide letter dated 30.12.2020, informed to the Appellant as under:Page 3 of 7
CIC/NITKS/A/2021/610123 Being dissatisfied, the appellant filed a First Appeal dated 03.01.2021, which has not been adjudicated by the First Appellate Authority as per available records.
Grounds for Second Appeal:
The Appellant filed a Second Appeal u/s 19 of the Act on the ground of unsatisfactory reply furnished by the Respondent. Appellant requested the Commission to direct the CPIO to provide complete information sought for.
Submissions made by Appellant and Respondent during Hearing:
The Appellant did not participate in the hearing despite being served the hearing notice.
The Respondent submitted that information with respect to the instant RTI Application, as available on record has been furnished to the Appellant vide reply dated 30.12.2020.
The Commission queried the Respondent regarding the status of First Appeal to which the Respondent submitted that the First Appeal has been adjudicated on 08.01.2021 and the contents of the same are as under:Page 4 of 7
CIC/NITKS/A/2021/610123 The Respondent further submitted that the compliance of the above order dated 08.01.2021 has been done vide letter dated 11.01.2021 and the contents of the same are as under:
The Commission queried the Respondent whether a copy of written submission has been sent to the appellant, to which the Respondent replied in affirmative.
A written submission has been received by the Commission from Shri. G.R. Samantaray, CPIO & Joint Registrar, NIT - Kurukshetra, vide letter dated 20.07.2022, wherein the commission has been apprised as under:Page 5 of 7
CIC/NITKS/A/2021/610123 Decision:
Upon perusal of the facts on record as well as on the basis of the proceedings during the hearing, the Commission observes that adequate reply has been provided by the Respondent qua the instant RTI Application vide letter dated 30.12.2020 and 11.01.2021. Moreover, the Appellant did not participate in the hearing to buttress his case, the Commission finds no further scope of intervention in the instant matter.
With the above observations, the instant Second Appeal is disposed of. Copy of the decision be provided free of cost to the parties.
The Appeal, hereby, stands disposed of.
