This order shall dispose of Civil Writ Petition Nos. 15049, 15556, 11873, 15027, 11786, 11785, 11706, 4269, 4270, 4271, 9430, 5223, 4723, 3618, 3513, 2893, 6055, 5448, 4576, 15139, 15141, 23586, 23725, 24143 of 2011 and 366, 377, 378 & 379 of 2012, as common questions of law and facts are involved in all the cases.
The petitioners are the erstwhile land owners, whose land was acquired for development of residential and commercial area by Haryana Urban Development Authority, for the purpose of Sectors 32 and 33, Urban Estate, Karnal.
The petitioners claim that they are entitled to residential Civil Writ Petition No. 5223 of 2011 (12) plots being oustees consequent to acquisition of their land.
Learned counsel for the respondents do not dispute the right of the agriculturists, such as the petitioners, whose land has been acquired for the purpose of development of urban area, for allotment of plots in terms of the policies formulated by the Haryana Urban Development Authority.
Learned counsel for the respondents has placed on record a communication dated 4th January, 2012, received from the Chief Administrator, HUDA.
Learned counsel for the respondents states that within six months, the Haryana Urban Development Authority shall advertise the plots in Sector 32 & Sector 33, Karnal, including the plots for the oustees. The petitioners can submit their applications in response to the advertisement to be issued and such applications shall be considered in accordance with law.
In view of the said statement, we dispose of the present writ petitions with a direction to the respondents to advertise the plots, including plots for the oustees in Sector 32 and 33, Karnal, within a period of six months i.e. not later than 31.07.2012. The respondents shall consider the applications of the oustees as per their entitlement and eligibility in accordance with law.
