ORAL ORDER
[PER: HON'BLE DR. LATA BASWARAJ PATNE, JUDICIAL MEMBER] The applicants filed the OA seeking the following relief:
"....to direct the respondents herein to absorb the applicants (ex-naval apprentices) as Tradesman skilled as per the SRO 150, dated 01.06.2000 without reference to Upper Age Limit as per orders dated 01.03.2010 in OA 51/2008 forthwith with all the consequential benefits and be pleased to pass other and further order or orders ..."
2. When the matter has been taken up, learned counsel for the applicants argued on the point that the Respondent Department had WP No. 31200 of 2010 before the Hon'ble High Court, challenging the order passed by this Tribunal in OA No.51 of 2008 dated 01.03.2010 and the same was dismissed as withdrawn at the instance of the respondent Department vide order dt. 14.03.2023. It is stated that when some of the applicants along with other similar persons had approached the Hon'ble High Court by filing Interlocutory Applications in the said Writ Petition, the High Court declined to entertain the claim of the applicants and directed them to avail the appropriate remedy, vide order dt. 19.07.2024. Accordingly, the applicants have approached this Tribunal in the present OA.
3. It is to be noted that the Hon'ble High Court, in its order, observed that if the applicants are still aggrieved, they could have agitated their claim before the competent authority of the respondents' Department. Therefore, the applicants should have exhausted appropriate remedies before the competent authority, but not by way of filing this OA. Without exhausting the remedies, the applicants filed the OA. Theretofore, we feel that this application cannot be entertained. Page 4 of 5

However, liberty is granted to the applicants to submit their individual representations to the competent authority among the respondents, within two weeks from the date of receipt of this order and the respondents are directed to consider the claim of the applicants, following the directions given by this Tribunal in OA No. 51/2008 & Batch, vide order dated 01.03.2010 and the subsequent orders passed by this Tribunal in OA No.1377/2011, 1204/2014 & batch, 782/2013 & batch, by passing a reasoned and speaking order, within three months from the date of receipt of the representation (s).
5. The OA is disposed of accordingly, at admission stage itself. No order as to costs.
