(3)An Officer or Soldier shall not wear his sword or side arms if he appears in the character of an accused person or under military arrest or if the Presiding Officer of the court think it necessary to require the surrender of his arms, in which case a statement of the reason for making the order shall be recorded by the Presiding Officer and, if the military authorities so request forwarded for the information to the Commander-in-chief.
