It has been submitted by learned counsel for the applicants that since the issue involved in this case is identical one, therefore, applicants' prayer to join together in a single application may be allowed; and is therefore allowed.

2. This application has been preferred to seek the following relief:
"8.1. That the Hon'ble Tribunal be pleased declare that the applicants are entitled to get the benefit of the Non Functional Grade (NFG) Pay scale of PB2 Rs. 9300-34800/- with Grade Pay of Rs. 5400/- from the date of their completion of 4 years of service in PB2 Rs. 9300-34800/- with Grade Pay of Rs. 4800/-.
8.2 That the Hon'ble Tribunal be pleased to direct the respondents to grant the non-functional upgradation to the applicants in the Grade Pay of Rs. 5400 in Pay Band-2 with effect from the date of completion of 4 years of regulars service by the individual applicant in the Grade Pay of Rs. 4800 with all consequential benefits including re-fixation of pay and allowances of the applicants with arrear monetary benefits in the light of the judgment and order dated 06.09.2010 rendered by the Hon'ble Madras High Court in WP (C) No. 13225/2010 (M. Subramaniam vs Union of India & Others).
8.3. Costs of the application 8.4. Any other relief(s) to which the applicants are entitled as the Hon'ble Tribunal may deem fit and proper."

As per the applicants, they are entitled to Non Functional Grade (NFG) in the grade pay of Rs. 5400/- in PB - 2 with effect from the date of completion of four years of service in Grade Pay Rs. 4800/-. Being aggrieved with, O.A. No/040/00053/2024 18 though they have preferred representations on different dates (Annexure A-19 colly), however, their prayers have not been considered till date. Hence, they have approached this Tribunal by filing the instant O.A.

During the course of hearing, learned counsel for the applicants has fairly submitted that presently it would suffice the purpose of the applicants if the respondent authorities be directed to consider the representations of the applicants (Annexure A19 colly) in the light of the judgement and order passed by the Hon'ble Madras High Court in WP (C) No. 13225/2010 (M. Subramaniam vs Union of India & Others) as well as various judgements of the coordinate Benches of Central Administrative Tribunal in OA/180/00862/2018 (Ernakulam Bench), OA/060/00541/2019 (Chandigarh Bench), O.A/503/2017 (Mumbai Bench) and O.A/40/00272/2019 (Guwahati Bench) and also in terms of the CBIT & Customs' Circular dated 27.04.2022, by treating this O.A. No/040/00053/2024 19 O.A as a part of it and disposed of the same in a time bound manner.
5. Sri. V. K. Bhatra, learned Sr. CGSC for the respondents has no objection for consideration of the representations of the applicants as per rules.
6. Heard the parties and perused the records as well as judgments cited above.
7. In view of the above, we deem it fit to dispose of the O.A with a direction upon the respondents/competent authority to consider the representations of the applicants (Annexure A19 colly) treating this O.A as part of it, in the light of the abovecited judgements (supra) and communicate their decision by way of a reasoned and speaking order within a period of two months from the date of receipt of copy of this order as well as the instant original application.

8. Applicants are directed to serve copy of the O.A along with copy of this order to the Respondents/competent authority.
