ORAL JUDGMENT

In compliance of my order dated 07.10.2015, Municipal
Commissioner, Patna Municipal Corporation is present and has filed
further show cause reiterating the stand taken by him earlier that he
has not released any fund for payment of arrears of difference of
salary pursuant to 6th Pay Revision after 24.08.2015. In this
connection, submission made by the counsel for the petitioners that
funds have been released under orders dated 01.09.2015 and
31.08.2015, Annexure-8 series is wholly misconceived, as perusal of the two orders would indicate that thereunder funds were directed to be released later. Meanwhile, Circle issued cheques dated 01.09.2015 and 31.08.2015 from the fund already entrusted to it, as is appearing Patna High Court MJC No.1670 of 2015 dt.08-10-2015 14 from Annexure-8 series itself.
In the circumstances, I am satisfied that the stand taken by the Municipal Commissioner, Patna Municipal Corporation in the different affidavits is correct. There being paucity of fund with the Corporation, arrears of difference of salary pursuant to 6th Pay Revision be paid to the remaining petitioners as and when fund is available, but before making payment to any other retired or serving employees, contempt petitioners be paid first.
All the contempt petitions are, accordingly, disposed of.
