1.PUBLIC PROSECUTOR The Court made the following: ORDER:I The Criminal Petition, u/See.482 of B.N.S.S is filed on behalf of the petitioners/A5 and A6 to grant anticipatory bail in connection with Crime No.109/2025 of Tadepalli Police Station, Guntur District.
2. A case has been registered against the petitioners herein and others for the offence punishable u/Sections 126(2),137(2), 109(1), 351(2) r/w 3(5) of Bharat'lya Nyaya Sanhita, 2023 (for short [B.N.Sl).

3. The case of the-- prosecution, in brl-ef, is that, on 07.03.2025 at 23.30 hours at service road towards MangalagirI' in Tadepalli, the defacto complainant and his friend pavan are returning from Tadepalli in their car, the accused tried to attack them, then the complainant and his friend rushed fastly in their car. The accused chased them in a i20 car and wrongfully restrained their car and forcefully brought complainant out of car and beat hl'm and forcefully taken him into their car and taken away near fields of Mellampudi Village. Meanwhile, his friend Pavan ran away. The accused beat him with hands and rods causing bleeding injuries on face and head. Meanwhile they asked for Nagendra and warned that they will kill them any way. The accused taken knifes and tried to kill complainant, in fear of life, the complainant shouted loudly and ran from their custody. Meanwhile some students of KLU and some farmers came to scene by listening to sounds, then the accused ran away.

5. The learned counsel forthe petitioners/A5 and A6 submits that no specific accusations have been made against these petitioners, and A3 was granted regular bail by the special Judge for Trial of Cases under the Scheduled Castes & Scheduled Tribes (Prevention of Atrocl-ties) Act, 1989, Gum-IV /?

J, Additional Sessions Judge, Guntur, in Crl.M.P.No.346 of 2025, dated 24.03.2025. On perusal of the report and material On record, it can be seen that the primary accusation is made against A1. According to the Case Of the Prosecution, the petitioners and the other accused were present at the scene of the offence. The contents of the report Show that When the petitioners and others attempted to attack, the de facto complainant and others left the scene in a car. Apart from the allegations made in the report, the prima facie evidence only 'lndicates the presence of the petitioners and others at the time of the alleged incident. The learned counsel for the Petitioners contends that the petitioners are B.Tech students, pursuing their education at K.L. University, and that their Careers Will be affected if they are arrested. When ascertained, the learned Assistant Public Prosecutor confirmed that the Petitioners have no prior antecedents. The learned Assistant Public Prosecutor further submits that some additional witnesses have been examined.

6. Considering the fact thatA3 was granted bail, this Court is of the view that granting anticipatory bail to these petitioners will not affect the investigation in any way. The learned counsel for the petitioners submits that the petitioners have permanent ty A,<, I 4 residences in Visakrfapatnam and SrI'kakulam, and there iS nO possibility of their fleeing from the jurisdiction of the Court.

7. ln view of the said reasons, this Court is inclined to grant anticipatory bail to the petitioners/A5 and A6.

Accordingly, the petitioners/A5 and A6 are directed to surrender before the Station House Officer concerned within two (2) weeks from today and on such surrender, the petitioners shall be released on bail on their executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the arresting police officials and also on condition that the petitioners shall make themselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. The petitioners shall appear before the concerning Station House Officer, once in a fortnight, within a period of two months.

9. With the above directions, the Criminal Petition is allowed.
