FACTS :
The matter is called for hearing today dated 25.3.2011. Appellant not present. The Department is represented by Shri A.K. Bhattacharya, Asstt PMG (Staff) & Shri A.B. Roy, Asstt Director. They are heard.
2. It is noticed that in the RTI application, the appellant had alleged that Shri Ram Prasad Roy had not been given promotion from HSG-II to HSG-I, despite the fact that he figured at Sr No 14 in the seniority list and the fact that his juniors had been promoted. Asstt PMG (Staff), Kolkata, vide letter dated 27.2.2010 had informed the appellant that Shri Ram Prasad Roy could not be promoted due to pendency of disciplinary case against him. On appeal, the AA in letter dated 16.6.2010 had reiterated the above position.
3. In the appeal memo filed before this Commission, the appellant wishes to know the charge against said Ram Prasad Roy for which his one grade increment has been withheld for 06 months.
4. During the hearing, Shri Bhattacharya submits that disciplinary proceedings were held against Shri Roy pursuant to which his one grade increment was stopped for 06 months. He also submits that after the expiry of the effect of the aforesaid order the case of Shri Roy will be considered afresh for giving him promotion to HSGI Cadre.
5. In view of the above discussion, it appears to us that the requisite information has already been provided to the appellant. The matter is, therefore, closed.
